Informations obligatoires<\/h5>\n\n\n\n<p>Afin d\u2019\u00eatre en conformit\u00e9 avec la Directive Europ\u00e9enne du 20 juin 2019, le l\u00e9gislateur a ins\u00e9r\u00e9 un nouvel article pr\u00e9voyant l\u2019obligation pour l\u2019employeur de<strong> communiquer au salari\u00e9 par \u00e9crit des documents pr\u00e9cisant les informations principales relatives \u00e0 la relation de travail<\/strong>, qui devront \u00eatre d\u00e9finies par D\u00e9cret, actuellement non paru.<\/p>\n\n\n\n<p>Pour les <strong>contrats en cours<\/strong>, les <strong>salari\u00e9s pourront mettre en demeure leur employeur<\/strong> de leur <strong>communiquer les informations manquantes<\/strong> et, \u00e0 d\u00e9faut, de <strong>saisir la juridiction comp\u00e9tente<\/strong>, selon des modalit\u00e9s pr\u00e9cis\u00e9es par D\u00e9cret \u00e0 paraitre.<\/p>\n\n\n\n<p>Il existe <strong>deux cas de dispense<\/strong>, si l\u2019emploi n\u2019exc\u00e8de pas<strong> 3 heures par semaine sur 4 semaines<\/strong>, avec utilisation du <strong>CESU<\/strong>, et en cas d\u2019<strong>emploi occasionnel d\u2019intermittent du spectacle<\/strong> via le dispositif GUSO (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047281777#:~:text=dol%2C%20majeurs%20prot%C3%A9g%C3%A9s-,LOI%20n%C2%B0%202023%2D171%20du%209%20mars%202023%20portant,de%20l'agriculture%20(1)\" target=\"_blank\" rel=\"noreferrer noopener\">article 19 de la loi n\u00b02023-171 du 9 mars 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Embauche &#8211; P\u00e9riode d\u2019essai<\/h5>\n\n\n\n<p>Les <strong>accords de branche<\/strong> pr\u00e9voyant une dur\u00e9e de <strong>p\u00e9riode d\u2019essai sup\u00e9rieure aux dispositions l\u00e9gales<\/strong> ont jusqu\u2019au mois de septembre 2023 pour <strong>modifier leur disposition<\/strong>.<\/p>\n\n\n\n<p><strong>Sont vis\u00e9es 9 conventions collectives<\/strong>, notamment celles des salari\u00e9s permanents des entreprises de travail temporaire, les entreprises de promotion construction, les organismes de formation, les soci\u00e9t\u00e9s d\u2019assurance, la banque, les mutualit\u00e9s (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047281777#:~:text=dol%2C%20majeurs%20prot%C3%A9g%C3%A9s-,LOI%20n%C2%B0%202023%2D171%20du%209%20mars%202023%20portant,de%20l'agriculture%20(1)\" target=\"_blank\" rel=\"noreferrer noopener\">article 19 de la Loi n\u00b0 n\u00b02023-171 du 9 mars 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; CDD<\/h5>\n\n\n\n<p>Le salari\u00e9 en <strong>CDD, et l&rsquo;int\u00e9rimaire,<\/strong> justifiant d\u2019au moins de <strong>6 mois continus d\u2019anciennet\u00e9 <\/strong>devra \u00eatre <strong>inform\u00e9 <\/strong>par son employeur (ou son entreprise utilisatrice), <strong>des postes en CDI \u00e0 pourvoir dans l\u2019entreprise, s\u2019il le demande.<\/strong><\/p>\n\n\n\n<p>Un d\u00e9cret devant d\u00e9finir les modalit\u00e9s est attendu (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047281777#:~:text=dol%2C%20majeurs%20prot%C3%A9g%C3%A9s-,LOI%20n%C2%B0%202023%2D171%20du%209%20mars%202023%20portant,de%20l'agriculture%20(1)\" target=\"_blank\" rel=\"noreferrer noopener\">article 19 de la Loi n\u00b0 n\u00b02023-171 du 9 mars 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Cong\u00e9 maladie chronique enfant<\/h5>\n\n\n\n<p>Un d\u00e9cret liste les<strong> pathologies chroniques chez les enfants ouvrant droit \u00e0 un cong\u00e9 r\u00e9mun\u00e9r\u00e9 d\u2019au moins 2 jours <\/strong>pour les parents salari\u00e9s, pr\u00e9vu par la loi du 17 d\u00e9cembre 2021.<\/p>\n\n\n\n<p>Sont ainsi prises en compte les maladies chroniques comportant un <strong>traitement prolong\u00e9<\/strong>, des maladies graves ouvrant droit \u00e0 exon\u00e9ration du ticket mod\u00e9rateur (<strong>diab\u00e8te, insuffisance cardiaque grave, mucoviscidose, etc.<\/strong>), et des <strong>maladies rares r\u00e9pertori\u00e9es dans la nomenclature Orphanet<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047358681\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02023-215 du 27 mars 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Cong\u00e9 paternit\u00e9<\/h5>\n\n\n\n<p>Le cong\u00e9 de paternit\u00e9 et d\u2019accueil de l\u2019enfant est <strong>consid\u00e9r\u00e9 comme du temps de travail effectif <\/strong>pour la d\u00e9termination des <strong>droits au titre de l\u2019anciennet\u00e9.<\/strong><\/p>\n\n\n\n<p>Pendant le cong\u00e9, le salari\u00e9 b\u00e9n\u00e9ficie du <strong>maintien des avantages individuels acquis<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047281777#:~:text=dol%2C%20majeurs%20prot%C3%A9g%C3%A9s-,LOI%20n%C2%B0%202023%2D171%20du%209%20mars%202023%20portant,de%20l'agriculture%20(1)\" target=\"_blank\" rel=\"noreferrer noopener\">Loi n\u00b02023-171 du 9 mars 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Cong\u00e9 parental d\u2019\u00e9ducation<\/h5>\n\n\n\n<p>La <strong>condition d\u2019anciennet\u00e9<\/strong> d\u2019un an pour b\u00e9n\u00e9ficier du cong\u00e9 parental d\u2019\u00e9ducation est <strong>am\u00e9nag\u00e9e<\/strong>, et pourra \u00eatre remplie ult\u00e9rieurement apr\u00e8s la naissance ou l\u2019adoption de l\u2019enfant.<\/p>\n\n\n\n<p>Dans un tel cas, le salari\u00e9 pourra alors prendre le cong\u00e9 jusqu\u2019au 3 ans de l\u2019enfant.<\/p>\n\n\n\n<p>De m\u00eame, la prise en compte de l\u2019anciennet\u00e9 pendant le cong\u00e9 parental d\u2019\u00e9ducation est clarifi\u00e9e : la <strong>totalit\u00e9 du cong\u00e9 \u00e0 temps partiel sera assimil\u00e9e \u00e0 une p\u00e9riode de travail effectif pour la d\u00e9termination des droits au titre de l\u2019anciennet\u00e9.<\/strong><\/p>\n\n\n\n<p>Pendant le cong\u00e9, le salari\u00e9 b\u00e9n\u00e9ficie du <strong>maintien des avantages individuels acquis<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047281777#:~:text=dol%2C%20majeurs%20prot%C3%A9g%C3%A9s-,LOI%20n%C2%B0%202023%2D171%20du%209%20mars%202023%20portant,de%20l'agriculture%20(1)\" target=\"_blank\" rel=\"noreferrer noopener\">Loi n\u00b02023-171 du 9 mars 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Cong\u00e9s de solidarit\u00e9 familiale et de proche aidant<\/h5>\n\n\n\n<p>Les cong\u00e9s de solidarit\u00e9 familiale et de proche aidant <strong>s\u2019appliquent<\/strong> maintenant <strong>\u00e9galement aux salari\u00e9s des particuliers employeurs, et aux assistants maternels de droit priv\u00e9 <\/strong>(<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047281777#:~:text=dol%2C%20majeurs%20prot%C3%A9g%C3%A9s-,LOI%20n%C2%B0%202023%2D171%20du%209%20mars%202023%20portant,de%20l'agriculture%20(1)\" target=\"_blank\" rel=\"noreferrer noopener\">Loi n\u00b02023-171 du 9 mars 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Participation<\/h5>\n\n\n\n<p>Le cong\u00e9 de paternit\u00e9 est assimil\u00e9 \u00e0 une<strong> p\u00e9riode de pr\u00e9sence d<\/strong>ans l&rsquo;entreprise pour la <strong>r\u00e9partition <\/strong>de la participation (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047281777#:~:text=dol%2C%20majeurs%20prot%C3%A9g%C3%A9s-,LOI%20n%C2%B0%202023%2D171%20du%209%20mars%202023%20portant,de%20l'agriculture%20(1)\" target=\"_blank\" rel=\"noreferrer noopener\">Article 18 de la loi n\u00b02023-171 du 9 mars 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Frais professionnels<\/h5>\n\n\n\n<p><strong>Revalorisation <\/strong>\u00e0 la hausse des <strong>bar\u00e8mes kilom\u00e9triques<\/strong> pour l\u2019\u00e9valuation des frais de d\u00e9placement des salari\u00e9s (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047416556\" target=\"_blank\" rel=\"noreferrer noopener\">Arr\u00eat\u00e9 du 27 mars 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Actualit\u00e9s jurisprudentielles<\/h2>\n\n\n\n<h5 class=\"wp-block-heading\">Formation du contrat &#8211; CDD<\/h5>\n\n\n\n<p>Le <strong>CDD sign\u00e9 avant l&rsquo;arriv\u00e9e du terme d&rsquo;un premier contrat n&rsquo;est pas un renouvellement du contrat initial<\/strong> <strong>s&rsquo;il n&rsquo;indique pas express\u00e9ment l&rsquo;\u00eatre<\/strong> et ce bien qu&rsquo;il contienne une clause de renouvellement. Il s&rsquo;agit d&rsquo;un nouveau contrat distinct du premier.<\/p>\n\n\n\n<p>Le d\u00e9lai de carence n\u2019ayant pas \u00e9t\u00e9 respect\u00e9, la requalification en CDI \u00e9tait donc bien encourue (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/63fefd52002ac605de15b34e?judilibre_juridiction=cc&amp;judilibre_chambre%5B0%5D=soc&amp;previousdecisionpage=0&amp;previousdecisionindex=5&amp;nextdecisionpage=0&amp;nextdecisionindex=7&amp;page=0\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 1<sup>er<\/sup> mars 2023, n\u00b021-20.431<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Egalit\u00e9 de traitement<\/h5>\n\n\n\n<p>Le principe d<strong>&lsquo;\u00e9galit\u00e9 de traitement<\/strong> entre les femmes et les hommes <strong>justifie la communication de bulletins de paie d&rsquo;autres salari\u00e9s<\/strong>, sur le fondement de l&rsquo;article 145 du CPC, quand bien m\u00eame cette mesure porterait atteinte \u00e0 leur vie personnelle, <strong>d\u00e8s lors qu&rsquo;elle est indispensable \u00e0 l&rsquo;exercice du droit \u00e0 la preuve<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/64085bce66b1bafb02f11fb0\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 8 mars 2023, n\u00b021-12.492<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; G\u00e9olocalisation<\/h5>\n\n\n\n<p>Les <strong>\u00e9l\u00e9ments de preuve<\/strong> issus d\u2019un dispositif de <strong>g\u00e9olocalisation<\/strong> <strong>en dehors des heures de travail sont illicites<\/strong>.<\/p>\n\n\n\n<p>Ces \u00e9l\u00e9ments de preuve illicites sont <strong>recevables <\/strong>en justice <strong>uniquement <\/strong>si la personne <strong>invoque son droit \u00e0 la preuve<\/strong>, et si l\u2019atteinte \u00e0 la vie personnelle du salari\u00e9 qui s\u2019en suit est <strong>strictement proportionn\u00e9e au regard du but poursuivi<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/641aaac70c73d704f534828a\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 22 mars 2023, n\u00b021-24.729 et 21-22.852<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Inaptitude<\/h5>\n\n\n\n<p>Dans le cadre de son obligation de <strong>reclassement<\/strong>, l\u2019employeur doit <strong>proposer un poste de travail en t\u00e9l\u00e9travail <\/strong>pour un salari\u00e9 d\u00e9clar\u00e9 inapte <strong>si le M\u00e9decin du travail le pr\u00e9conise,<\/strong> peu importe si le t\u00e9l\u00e9travail n\u2019a pas \u00e9t\u00e9 mis en place au sein de l\u2019entreprise. La <strong>seule dispense l\u00e9gitime <\/strong>serait que les <strong>fonctions ne puissent pas s\u2019exercer en t\u00e9l\u00e9travail<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6423d6e178684f04f5813f93\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 29 mars 2023, n\u00b021-15.472<\/a><\/u><\/em>)<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Dur\u00e9e du travail &#8211; Cadre Dirigeant<\/h5>\n\n\n\n<p>Un <strong>DRH<\/strong> qui a une <strong>grande autonomie<\/strong> dans l\u2019exercice de ses fonctions <strong>mais qui doit en r\u00e9f\u00e9rer au Directeur G\u00e9n\u00e9ral <\/strong>pour prendre des d\u00e9cisions, et q<strong>ui ne signe pas les lettres <\/strong>de convocation \u00e0 entretien pr\u00e9alable et lettres de <strong>licenciement<\/strong>, <strong>n\u2019a pas la qualit\u00e9 de Cadre Dirigeant<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/en\/decision\/641173f1f6c989fb02435769?judilibre_chambre%5B0%5D=soc&amp;page=2&amp;previousdecisionpage=2&amp;previousdecisionindex=8&amp;nextdecisionpage=3&amp;nextdecisionindex=0\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 15 mars 2023, n\u00b021-21.632<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Versement du salaire<\/h5>\n\n\n\n<p>La d\u00e9livrance d\u2019un bulletin de salaire ne d\u00e9montre pas le paiement de la r\u00e9mun\u00e9ration. L\u2019employeur doit donc justifier du paiement, notamment par la production de pi\u00e8ces comptables (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6423d7cf78684f04f5814067\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 29 mars 2023, n\u00b021-19.631<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Minimum conventionnel<\/h5>\n\n\n\n<p>L\u2019employeur qui <strong>accorde unilat\u00e9ralement<\/strong> au salari\u00e9 <strong>un coefficient sup\u00e9rieur <\/strong>\u00e0 celui des fonctions r\u00e9ellement exerc\u00e9es doit <strong>lui faire b\u00e9n\u00e9ficier obligatoirement de la r\u00e9mun\u00e9ration correspondant \u00e0 ce coefficient<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000047268996?init=true&amp;isAdvancedResult=true&amp;numAffaire=21-25376&amp;page=1&amp;pageSize=10&amp;query=%7B%28%40ALL%5Bt%22*%22%5D%29%7D&amp;sortValue=DATE_DESC&amp;tab_selection=juri&amp;typeRecherche=date\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 1er mars 2023, n\u00b021-25.376<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; CDD<\/h5>\n\n\n\n<p>La <strong>faute grave<\/strong> ne peut motiver la <strong>rupture anticip\u00e9e<\/strong> du CDD <strong>que si les faits ont \u00e9t\u00e9 commis au cours du contrat. <\/strong>S\u2019ils ont \u00e9t\u00e9 commis ant\u00e9rieurement \u00e0 la prise d\u2019effet du contrat, la rupture pour faute grave est consid\u00e9r\u00e9e comme injustifi\u00e9e (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/64117333f6c989fb024356a5\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 15 mars 2023, n\u00b021-17.227<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; PSE<\/h5>\n\n\n\n<p>Si une<strong> r\u00e9organisation pr\u00e9sente des risques pour la sant\u00e9 ou la s\u00e9curit\u00e9 <\/strong>des travailleurs, notamment en terme psycho-sociaux, le <strong>PSE doit contenir des mesures de pr\u00e9vention et de protection pr\u00e9cises et concr\u00e8tes,<\/strong> sur lesquelles le <strong>CSE doit avoir \u00e9t\u00e9 r\u00e9guli\u00e8rement inform\u00e9 et consult\u00e9.<\/strong><\/p>\n\n\n\n<p><strong>A d\u00e9faut,<\/strong> le PSE ne PSE ne sera <strong>pas valid\u00e9 ou homologu\u00e9<\/strong> par l\u2019Administration (<em><u><a href=\"https:\/\/www.economie.gouv.fr\/daj\/lettre-de-la-daj-plans-sociaux-et-risques-psychosociaux-trois-decisions-du-conseil-detat\" target=\"_blank\" rel=\"noreferrer noopener\">Conseil d\u2019Etat, 21 mars 2023, n\u00b0460660\/460924<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Repr\u00e9sentants du personnel &#8211; Consultation du CSE<\/h5>\n\n\n\n<p>En pr\u00e9sence d\u2019un <strong>accord GPEC,<\/strong> le <strong>CSE n\u2019a pas \u00e0 \u00eatre consult\u00e9<\/strong> \u00e0 ce sujet au titre de la consultation annuelle sur les orientations strat\u00e9giques de l\u2019entreprise.<\/p>\n\n\n\n<p><strong>Mais les mesures de mise en \u0153uvre<\/strong> de l\u2019accord GPEC peuvent avoir un i<strong>mpact sur l\u2019organisation, la gestion et la marche de l\u2019entreprise. <\/strong>Dans un tel cas, <strong>le CSE devra \u00eatre consult\u00e9<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6423d6e378684f04f5813f95\" target=\"_blank\" rel=\"noreferrer noopener\">Cass.
