DOETH<\/h5>\n\n\n\n<p>La <strong>d\u00e9claration DOETH<\/strong> des employeurs de plus de 20 salari\u00e9s doit \u00eatre r\u00e9alis\u00e9e <strong>via la DSN d\u2019avril<\/strong> (et non plus f\u00e9vrier), et reste exigible le 5 ou le 15 mai.<\/p>\n\n\n\n<p><strong>A d\u00e9faut de respect<\/strong> de l\u2019obligation d\u00e9clarative, une contribution forfaitaire avec <strong>majoration de 25%<\/strong> est encourue, augment\u00e9e de 5 points pour chaque \u00e9ch\u00e9ance non d\u00e9clar\u00e9e cons\u00e9cutive.<\/p>\n\n\n\n<p>En cas de r\u00e9gularisation, la majoration est limit\u00e9e \u00e0 8%.<\/p>\n\n\n\n<p>Il est pr\u00e9vu \u00e0 titre transitoire une <strong>possibilit\u00e9 de r\u00e9gularisation sans majoration jusqu\u2019\u00e0 la DSN du mois de juillet 2023<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047476694\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02023-296 du 20 avril 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Embauche &#8211; CDD<\/h5>\n\n\n\n<p>Le d\u00e9cret fixant la <strong>liste des secteurs<\/strong> concern\u00e9s par l\u2019exp\u00e9rimentation des <strong>CDD ou contrats de mission d\u2019int\u00e9rim multi-remplacement<\/strong> est paru.<\/p>\n\n\n\n<p>Ce dispositif concerne notamment l\u2019hospitalisation priv\u00e9e, les \u00e9tablissements m\u00e9dico-sociaux, les entreprises de propret\u00e9, l\u2019aide et services \u00e0 domicile les entreprises de commerce de d\u00e9tail et de gros \u00e0 pr\u00e9dominance alimentaires, etc.<\/p>\n\n\n\n<p>Le dispositif s\u2019applique jusqu\u2019au 13 avril 2025 (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047433992\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02023-263 du 12 avril 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Mise \u00e0 la retraite<\/h5>\n\n\n\n<p><strong>L\u2019indemnit\u00e9<\/strong> de mise \u00e0 la retraite est actuellement assujettie \u00e0 une contribution patronale sp\u00e9cifique de 50%.<\/p>\n\n\n\n<p>\u00a0Au 1<sup>er<\/sup> septembre 2023, ce <strong>taux de contribution patronale est abaiss\u00e9 \u00e0 30%<\/strong> et s\u2019applique sur la fraction de l\u2019indemnit\u00e9 exon\u00e9r\u00e9e de cotisations sociales (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000047445085#:~:text=%2DEst%20institu%C3%A9e%2C%20%C3%A0%20la%20charge,mentionn%C3%A9e%20%C3%A0%20l'article%20L.\" target=\"_blank\" rel=\"noreferrer noopener\">article 4 de la Loi n\u00b02023-1070 du 14 avril 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Rupture conventionnelle<\/h5>\n\n\n\n<p>Actuellement,<strong> L\u2019indemnit\u00e9 de rupture conventionnelle<\/strong> d\u2019un salari\u00e9 ne b\u00e9n\u00e9ficiant pas de ses droits \u00e0 la retraite est, en r\u00e8gle g\u00e9n\u00e9rale, exon\u00e9r\u00e9e de cotisations sociales et soumise \u00e0 un forfait social de 20%.<\/p>\n\n\n\n<p>Dans les autres cas, l\u2019indemnit\u00e9 est soumise \u00e0 charges sociales, et imposable \u00e0 l\u2019imp\u00f4t sur le revenu.<\/p>\n\n\n\n<p>Au 1<sup>er<\/sup> septembre 2023, quel que soit l\u2019\u00e2ge de d\u00e9part du salari\u00e9, l\u2019indemnit\u00e9 de rupture conventionnelle sera exon\u00e9r\u00e9e de charges sociales dans la limite de 10 PASS, mais sera <strong>assujettie \u00e0 une contribution patronale sp\u00e9cifique de 30%<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000047445085#:~:text=%2DEst%20institu%C3%A9e%2C%20%C3%A0%20la%20charge,mentionn%C3%A9e%20%C3%A0%20l'article%20L.\" target=\"_blank\" rel=\"noreferrer noopener\">article 4 de la Loi n\u00b02023-1070 du 14 avril 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Pr\u00e9somption de d\u00e9mission<\/h5>\n\n\n\n<p>Un D\u00e9cret pr\u00e9cise la <strong>proc\u00e9dure<\/strong> \u00e0 mettre en \u0153uvre par l\u2019Employeur pour que le salari\u00e9 absent sans justification de son poste de travail soit <strong>pr\u00e9sum\u00e9 d\u00e9missionnaire<\/strong>, et son contrat rompu.<\/p>\n\n\n\n<p>L\u2019employeur devra <strong>mettre en demeure<\/strong> son salari\u00e9 de justifier de son absence et de reprendre son poste <strong>dans un d\u00e9lai d\u2019au moins 15 jours calendaires<\/strong> \u00e0 compter de la date de premi\u00e8re pr\u00e9sentation de la lettre recommand\u00e9e AR ou lettre remise en main propre.<\/p>\n\n\n\n<p>Si le salari\u00e9 souhaite se pr\u00e9valoir d\u2019un motif l\u00e9gitime (\u00e9tat de sant\u00e9,<\/p>\n\n\n\n<p>droit de retrait, gr\u00e8ve, refus d\u2019une modification de son contrat, etc.), il doit l\u2019indiquer dans sa r\u00e9ponse.<\/p>\n\n\n\n<p>L\u2019Administration a pr\u00e9cis\u00e9 que <strong>le d\u00e9lai de pr\u00e9avis pr\u00e9vu dans le cadre de la d\u00e9mission devait \u00eatre respect\u00e9<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047455109\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02023-275 du 17 avril 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Retraite<\/h5>\n\n\n\n<p><strong>L\u2019\u00e2ge de d\u00e9part \u00e0 la retraite est de 64 ans<\/strong> pour les personnes n\u00e9es \u00e0 compter du 1<sup>er<\/sup> janvier 1968.<\/p>\n\n\n\n<p>Pour ceux n\u00e9s avant le 1<sup>er<\/sup> janvier 1968, un d\u00e9cret fixera l\u2019\u00e2ge de d\u00e9part (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000047445097#:~:text=%C2%AB%20Par%20d%C3%A9rogation%20au%20premier%20alin%C3%A9a,fix%C3%A9%20%C3%A0%20soixante%2Ddeux%20ans.\">article 10 de la Loi n\u00b02023-1070 du 14 avril 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"> Rupture du contrat &#8211; Cumul Emploi-Retraite<\/h5>\n\n\n\n<p>A compter du 1<sup>er<\/sup> septembre 2023, le salari\u00e9 en <strong>dispositif de cumul emploi-retraite b\u00e9n\u00e9ficiera de l\u2019acquisition de droits \u00e0 la retraite<\/strong>, sans incidence sur le montant de la pension d\u00e9j\u00e0 liquid\u00e9e, mais permettant une deuxi\u00e8me liquidation plafonn\u00e9e.<\/p>\n\n\n\n<p>Il ne b\u00e9n\u00e9ficiera n\u00e9anmoins pas des indemnit\u00e9s de d\u00e9part et de mise \u00e0 la retraite (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000047445113\" target=\"_blank\" rel=\"noreferrer noopener\">article 26-I de la Loi n\u00b02023-1070 du 14 avril 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Retraite progressive<\/h5>\n\n\n\n<p><strong>L\u2019\u00e2ge d\u2019acc\u00e8s <\/strong>au dispositif de retraite progressive va progressivement s\u2019\u00e9lever de 60 ans \u00e0<strong> 62 ans.<\/strong><\/p>\n\n\n\n<p>Le champ des b\u00e9n\u00e9ficiaires va s\u2019\u00e9largir, en prenant en compte \u00e9galement les professions lib\u00e9rales, mais aussi les VRP, les pigistes, et les assur\u00e9s titulaires d\u2019une pension d\u2019invalidit\u00e9.<\/p>\n\n\n\n<p>Les <strong>possibilit\u00e9s de refus<\/strong> pour l\u2019Employeur <strong>sont<\/strong> <strong>restreintes<\/strong> \u00e0 l\u2019incompatibilit\u00e9 de la dur\u00e9e du travail avec l\u2019activit\u00e9 \u00e9conomique de l\u2019entreprise.<\/p>\n\n\n\n<p>A d\u00e9faut de r\u00e9ponse de l\u2019employeur dans un <strong>d\u00e9lai de 2 mois<\/strong>, la <strong>demande<\/strong> du salari\u00e9 est <strong>r\u00e9put\u00e9e avoir \u00e9t\u00e9 accept\u00e9e<\/strong>.<\/p>\n\n\n\n<p>Enfin, le salari\u00e9 pourra demander une <strong>d\u00e9rogation \u00e0 la dur\u00e9e minimale du temps partiel (24h \/ semaine)<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000047445113\" target=\"_blank\" rel=\"noreferrer noopener\">article 26 de la Loi n\u00b02023-1070 du 14 avril 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Actualit\u00e9s jurisprudentielles<\/h2>\n\n\n\n<h5 class=\"wp-block-heading\">Formation du contrat &#8211; CDD<\/h5>\n\n\n\n<p>Le <strong>CDD sign\u00e9 avant l&rsquo;arriv\u00e9e du terme d&rsquo;un premier contrat n&rsquo;est pas un renouvellement du contrat initial s&rsquo;il n&rsquo;indique pas express\u00e9ment l&rsquo;\u00eatre <\/strong>et ce bien qu&rsquo;il contienne une clause de renouvellement. Il s&rsquo;agit d&rsquo;un nouveau contrat distinct du premier.<\/p>\n\n\n\n<p>Le d\u00e9lai de carence n\u2019ayant pas \u00e9t\u00e9 respect\u00e9, la requalification en CDI \u00e9tait donc bien encourue (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/63fefd52002ac605de15b34e?judilibre_juridiction=cc&amp;judilibre_chambre%5B0%5D=soc&amp;previousdecisionpage=0&amp;previousdecisionindex=5&amp;nextdecisionpage=0&amp;nextdecisionindex=7&amp;page=0\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 1<sup>er<\/sup> mars 2023, n\u00b021-20.431<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Temps partiel<\/h5>\n\n\n\n<p>L\u2019employeur a <strong>l\u2019obligation de porter \u00e0 la connaissance du salari\u00e9 \u00e0 temps partiel<\/strong> qui le demande la <strong>liste des postes disponibles<\/strong> \u00e0 temps partiel d\u2019au moins 24h\/semaine, ou \u00e0 temps complet, de sa cat\u00e9gorie professionnelle ou d\u2019un emploi \u00e9quivalent.<\/p>\n\n\n\n<p><strong>En cas de litige<\/strong>, <strong>c\u2019est \u00e0 l\u2019employeur de d\u00e9montrer qu\u2019il a satisfait \u00e0 son obligation<\/strong> d\u2019information, ou en justifiant de l\u2019absence de tels postes (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6437a1d19477fe04f5cc68ce\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 13 avril 2023, n\u00b021-19.742<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Prime Partage de la Valeur<\/h5>\n\n\n\n<p>Pendant la p\u00e9riode de <strong>cong\u00e9 de reclassement<\/strong>, applicable pour les salari\u00e9s licenci\u00e9s pour motif \u00e9conomique dans les entreprises de 1.000 salari\u00e9s et plus, le contrat de travail n\u2019est pas rompu.<\/p>\n\n\n\n<p>La <strong>prime de partage de la valeur<\/strong> peut \u00eatre <strong>modul\u00e9e en fonction de la dur\u00e9e de pr\u00e9sence<\/strong> dans l\u2019entreprise.<\/p>\n\n\n\n<p>Pour la Cour de cassation, la p\u00e9riode de cong\u00e9 de reclassement <strong>n\u2019est pas assimil\u00e9e \u00e0 du temps de travail effectif<\/strong>.<\/p>\n\n\n\n<p>N\u00e9anmoins, le salari\u00e9 a <strong>droit au paiement <\/strong>de la prime de partage de la valeur <strong>pour la p\u00e9riode correspondant \u00e0 celle du pr\u00e9avis<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/643f868aad85da04f53a3947\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 19 avril 2023, n\u00b021-23.092<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Tickets Restaurants<\/h5>\n\n\n\n<p>Le <strong>salari\u00e9 \u00e0 temps partiel<\/strong> <strong>peut b\u00e9n\u00e9ficier de tickets restaurants<\/strong> <strong>si ses<\/strong> <strong>horaires de travail recoupent la pause d\u00e9jeuner<\/strong>, qu\u2019il ait pris ou non cette pause (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000047454876?init=true&amp;page=1&amp;query=21-11.322&amp;searchField=ALL&amp;tab_selection=all\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 13 avril 2023, n\u00b021-11 322<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Participation<\/h5>\n\n\n\n<p><strong>L\u2019action en paiement<\/strong> de la Participation <strong>se<\/strong> <strong>prescrit par 2 ans<\/strong> \u00e0 compter du jour o\u00f9 le salari\u00e9 a connu ou aurait d\u00fb connaitre les faits lui permettant d\u2019exercer son droit (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6437a1d89477fe04f5cc68d6\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 13 avril 2023, n\u00b021-22.455<\/a>)<\/u><\/em>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Licenciement \u00e9conomique<\/h5>\n\n\n\n<p><strong>En cas d\u2019adh\u00e9sion<\/strong> par un salari\u00e9 du <strong>CSP<\/strong>, <strong>l\u2019employeur doit l\u2019informer par \u00e9crit du motif de la rupture<\/strong>.<\/p>\n\n\n\n<p>Ce <strong>motif peut \u00eatre pr\u00e9cis\u00e9 dans les 15 jours de l&rsquo;acceptation du CSP<\/strong>, \u00e0 la demande du salari\u00e9 ou \u00e0 l&rsquo;initiative de l&#8217;employeur (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/642d11abcb8fa004f57d9eb1\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 5 avril 2023, n\u00b021-18.636<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Repr\u00e9sentant du personnel &#8211; Cr\u00e9dit d\u2019heures<\/h5>\n\n\n\n<p>La <strong>contestation<\/strong> de l\u2019utilisation du <strong>cr\u00e9dit d\u2019heures<\/strong> de d\u00e9l\u00e9gation <strong>en dehors du temps de travail<\/strong> est possible si les n\u00e9cessit\u00e9s du mandat ne le justifiaient pas.<\/p>\n\n\n\n<p>&nbsp;N\u00e9anmoins, il n\u2019est <strong>pas possible de saisir en r\u00e9f\u00e9r\u00e9 la juridiction<\/strong> <strong>pour obtenir la justification par le salari\u00e9 de ces n\u00e9cessit\u00e9s.<\/strong><\/p>\n\n\n\n<p>L\u2019employeur n\u2019aura donc d\u2019autre choix que de <strong>saisir le juge au fond<\/strong> pour obtenir du salari\u00e9 la justification de ces heures de d\u00e9l\u00e9gation prises en dehors de son temps de travail (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/642d11b3cb8fa004f57d9eb9\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 5 avril 2023, n\u00b021-17.851<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Repr\u00e9sentant du personnel &#8211; D\u00e9l\u00e9gu\u00e9 syndical<\/h5>\n\n\n\n<p>Le DS doit \u00eatre choisi en priorit\u00e9 parmi les \u00e9lus et candidats ayant obtenu au moins 10 % des suffrages aux derni\u00e8res \u00e9lections.<\/p>\n\n\n\n<p>Ces derniers peuvent toutefois y renoncer.<\/p>\n\n\n\n<p>Cette <strong>renonciation<\/strong> n\u2019est toutefois <strong>pas d\u00e9finitive<\/strong> et un candidat <strong>peut revenir sur sa d\u00e9cision au cours du cycle \u00e9lectoral.<\/strong><\/p>\n\n\n\n<p>De m\u00eame, <strong>le candidat<\/strong> ayant obtenu au moins 10% des suffrages qui <strong>n\u2019est pas \u00e0 jour de ses cotisations<\/strong> <strong>est consid\u00e9r\u00e9 comme ayant renonc\u00e9 \u00e0 ses activit\u00e9s syndicales.<\/strong><\/p>\n\n\n\n<p>Le syndicat n\u2019a donc pas \u00e0 obtenir par \u00e9crit sa renonciation pour d\u00e9signer un autre adh\u00e9rent comme DS (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000047482957?init=true&amp;page=1&amp;query=21-23.348&amp;searchField=ALL&amp;tab_selection=all\" target=\"_blank\" rel=\"noreferrer noopener\">Cass, 19 avril 2023, n\u00b021-23.348<\/a> <a href=\"https:\/\/www.courdecassation.fr\/en\/decision\/643f868fad85da04f53a394d\" target=\"_blank\" rel=\"noreferrer noopener\">et 21-60.127<\/a><\/u><\/em>).<\/p>\n\n\n\n<p><strong><u>Revirement de jurisprudence<\/u><\/strong>\u00a0: Dans une entreprise de <strong>moins de 50 salari\u00e9s<\/strong>, le <strong>syndicat repr\u00e9sentatif<\/strong> peut <strong>choisir librement son DS parmi l\u2019ensemble des \u00e9lus du CSE<\/strong>, peu importe qu\u2019il ait \u00e9t\u00e9 \u00e9lu sous la banni\u00e8re d\u2019un autre syndicat lors des derni\u00e8res \u00e9lections professionnelles (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/643f8692ad85da04f53a3951\" target=\"_blank\" rel=\"noreferrer noopener\">Cass.
