COVID-19<\/h5>\n\n\n\n<p><strong>Fin de suspension au 15 mai 2023 de l\u2019obligation vaccinale du personnel soignant.<\/strong><\/p>\n\n\n\n<p>Le personnel doit \u00eatre r\u00e9int\u00e9gr\u00e9 \u00e0 leur poste initial, ou un emploi \u00e9quivalent (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047542116\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02023-368 du 13 mai 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat- CSP<\/h5>\n\n\n\n<p>Les <strong>avenants de prolongation<\/strong> des Contrats de s\u00e9curisation professionnels (CSP) <strong>jusqu\u2019au 31 d\u00e9cembre 2023<\/strong> ont \u00e9t\u00e9 agr\u00e9\u00e9s.<\/p>\n\n\n\n<p>Pour rappel ces avenants pr\u00e9voient que la <strong>dur\u00e9e d\u2019indemnisation n\u2019est pas impact\u00e9e<\/strong> par le dispositif de modulation de l\u2019allocation ch\u00f4mage pr\u00e9vue, ce qui est tr\u00e8s favorable pour le salari\u00e9 (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047664541\" target=\"_blank\" rel=\"noreferrer noopener\">Arr\u00eat\u00e9 du 9 juin 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Formation &#8211; Compte personnel de formation<\/h5>\n\n\n\n<p>A compter du 1<sup>er<\/sup> janvier 2024, le <strong>CPF<\/strong> pourra <strong>financer toutes les cat\u00e9gories de permis de conduire d\u2019un v\u00e9hicule terrestre \u00e0 moteur<\/strong> (voiture, poids lourds, motos l\u00e9g\u00e8res, etc.).<\/p>\n\n\n\n<p>Les conditions et modalit\u00e9s d\u2019\u00e9ligibilit\u00e9 devront \u00eatre pr\u00e9cis\u00e9es par un d\u00e9cret \u00e0 paraitre (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000047709062\" target=\"_blank\" rel=\"noreferrer noopener\">Article 3 de la Loi n\u00b02023-479 du 21 juin 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Formation- VAE<\/h5>\n\n\n\n<p>La loi du 21 d\u00e9cembre 2022 a mis en place pour 3 ans des contrats de professionnalisation comportant des actions en vue de la VAE, afin de simplifier l\u2019acc\u00e8s \u00e0 la certification (VAE invers\u00e9e).<\/p>\n\n\n\n<p>Un <strong>D\u00e9cret du 26 mai 2023 d\u00e9finit les modalit\u00e9s<\/strong>&nbsp;:<\/p>\n\n\n\n<p>&#8211; <strong>Public \u00e9ligible<\/strong>&nbsp;: Personnes 16 ans +<\/p>\n\n\n\n<p>&#8211;&nbsp; <strong>Prestataires<\/strong>&nbsp;: laur\u00e9ats d\u2019un appel \u00e0 projets national, dans la limite de <strong>5.000 parcours individuels<\/strong> (un <strong>cahier des charges<\/strong> sera convenu par Arr\u00eat\u00e9)<\/p>\n\n\n\n<p>&#8211; <strong>Frais pris en charge\u00a0par les OPCO<\/strong>\u00a0: frais de conception et de coordination des actions, frais p\u00e9dagogiques des actions de formation, frais d\u2019accompagnement \u00e0 la VAE, frais annexes (restauration, h\u00e9bergement, transport), d\u00e9penses li\u00e9es au fonction de tutorat (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047596683\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02023-408 du 26 mai 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">ACTUALITES JURISPRUDENTIELLES<\/h2>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Inaptitude et reclassement<\/h5>\n\n\n\n<p>L\u2019employeur doit <strong>proposer un poste<\/strong> au salari\u00e9 d\u00e9clar\u00e9 inapte <strong>conforme<\/strong> <strong>aux pr\u00e9conisations<\/strong>, au besoin en demande au M\u00e9decin du travail son avis.<\/p>\n\n\n\n<p>Cette obligation <strong>s\u2019applique<\/strong> \u00e9galement lorsque le <strong>poste est sp\u00e9cialement cr\u00e9\u00e9<\/strong> lors du reclassement (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6492960717c95e05dbf9dd9b?search_api_fulltext=21-24.279&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 21 juin 2023, n\u00b021-24.279<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Transfert d\u2019entreprise<\/h5>\n\n\n\n<p>L\u2019existence d\u2019une <strong>entit\u00e9 \u00e9conomique autonome peut r\u00e9sulter de deux parties de Soci\u00e9t\u00e9s distinctes d\u2019un m\u00eame Groupe<\/strong>.<\/p>\n\n\n\n<p>D\u00e8s lors, les dispositions de l\u2019article L. 1224-1 du Code du travail et le maintien de plein droit des contrats de travail des salari\u00e9s concern\u00e9s s\u2019appliquent (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/649be080a10c4805db86faa3?search_api_fulltext=22-14.834&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 28 juin 2023, n\u00b022-14.834<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Usage<\/h5>\n\n\n\n<p>Un <strong>avantage pour un seul salari\u00e9 peut remplir la condition de g\u00e9n\u00e9ralit\u00e9<\/strong> de l\u2019usage <strong>s\u2019il est l\u2019unique repr\u00e9sentant d\u2019une cat\u00e9gorie de personnel.<\/strong><\/p>\n\n\n\n<p>S\u2019il remplit les autres crit\u00e8res de constance et de fixit\u00e9, il ne peut \u00eatre supprim\u00e9 qu\u2019apr\u00e8s le respect de la proc\u00e9dure de d\u00e9nonciation (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6492971817c95e05dbf9de99?search_api_fulltext=21-22.076&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 21 juin 2023, n\u00b021-22.076<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Lanceur d\u2019alerte<\/h5>\n\n\n\n<p>Pour pouvoir b\u00e9n\u00e9ficier de la protection au titre du statut de lanceur d\u2019alerte, le salari\u00e9 doit avoir d\u00e9nonc\u00e9 des faits constitutifs d\u2019un d\u00e9lit ou d\u2019un crime.<\/p>\n\n\n\n<p>L\u2019email d\u2019un salari\u00e9 \u00e0 son Pr\u00e9sident qui mettait en cause la l\u00e9galit\u00e9 ou la r\u00e9gularit\u00e9 de la proc\u00e9dure de mise en place d\u2019une carte de fid\u00e9lit\u00e9 ne suffit pas \u00e0 consid\u00e9rer cela comme une infraction d\u00e9lictuelle ou criminelle. Le salari\u00e9 ne b\u00e9n\u00e9ficie donc pas du statut de lanceur d\u2019alerte. Soc., 1<sup>er<\/sup> juin 2023, n\u00b022-11.310<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Dur\u00e9e du travail &#8211; Temps de d\u00e9placement<\/h5>\n\n\n\n<p>Le <strong>temps de d\u00e9placement au sein de l\u2019enceinte<\/strong> de l\u2019entreprise avant la prise de poste <strong>peut \u00eatre qualifi\u00e9 de temps de travail effectif<\/strong> si le salari\u00e9 est \u00e0 la disposition de l\u2019employeur et se conforme \u00e0 ses directives sans pouvoir vaquer librement \u00e0 ses occupations personnelles.<\/p>\n\n\n\n<p>Cette <strong>appr\u00e9ciation<\/strong> s\u2019effectue <strong>au cas par cas.<\/strong><\/p>\n\n\n\n<p>Des suj\u00e9tions impos\u00e9es \u00e0 peine de sanctions disciplinaires sur le parcours amenant \u00e0 son poste peuvent donc \u00eatre un indice pour retenir la qualification de temps de travail effectif (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/64802078f17e00d0f8b572a4?search_api_fulltext=21-12.841&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;op=Rechercher+sur+judilibre&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 7 juin 2023, n\u00b021-12.841<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Dur\u00e9e du contrat &#8211; Dur\u00e9e maximale<\/h5>\n\n\n\n<p>Le <strong>d\u00e9passement de la dur\u00e9e maximale<\/strong> quotidienne de travail ouvre \u00e0 lui seul <strong>droit \u00e0 indemnisation<\/strong> pour le salari\u00e9, sans avoir \u00e0 d\u00e9montrer un pr\u00e9judice<a href=\"https:\/\/www.courdecassation.fr\/decision\/645c944fe48085d0f84a3577?search_api_fulltext=21-22.281&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;previousdecisionpage=0&amp;previousdecisionindex=0&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\"> (<em><u>Cass. Soc., 11 mai 2023, n\u00b021-22.281<\/u><\/em><\/a>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; R\u00e9mun\u00e9ration variable<\/h5>\n\n\n\n<p>Par principe, les <strong>objectifs<\/strong> fix\u00e9s au titre de la r\u00e9mun\u00e9ration variable doivent \u00eatre <strong>r\u00e9dig\u00e9s en fran\u00e7ais<\/strong>.<\/p>\n\n\n\n<p>Un plan de commissionnement r\u00e9dig\u00e9 en anglais fixant les objectifs, et <strong>non traduit<\/strong> en Fran\u00e7ais est <strong>inopposable<\/strong>.<\/p>\n\n\n\n<p>Les objectifs sont donc consid\u00e9r\u00e9s comme remplis, et le salari\u00e9 a droit \u00e0 l\u2019int\u00e9gralit\u00e9 de sa r\u00e9mun\u00e9ration variable.<\/p>\n\n\n\n<p>Les seules exceptions sont que la personne est de nationalit\u00e9 \u00e9trang\u00e8re, que les documents sont re\u00e7us de l\u2019\u00e9tranger, ou si l\u2019activit\u00e9 de l\u2019entreprise n\u00e9cessite l\u2019usage d\u2019une langue \u00e9trang\u00e8re (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/648020e0f17e00d0f8b57310?search_api_fulltext=21-20.322&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 7 juin 2023, n\u00b021-20.322<\/a>)<\/u><\/em>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Avantage en nature<\/h5>\n\n\n\n<p>L&rsquo;usage priv\u00e9 d&rsquo;un v\u00e9hicule mis \u00e0 disposition par un tiers et pris en charge par l\u2019employeur constitue un avantage en nature, soumis \u00e0 charges sociales.<\/p>\n\n\n\n<p>Son \u00e9valuation s\u2019effectue, sur option, soit sur la base des d\u00e9penses r\u00e9ellement engag\u00e9es, soit sur la base d\u2019un forfait annuel (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/645c94d1e48085d0f84a35e1?search_api_fulltext=21-24.242&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Civ. 2<sup>\u00e8me<\/sup>, 11 mai 2023, n\u00b021-24.242<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Participation<\/h5>\n\n\n\n<p>Une <strong>soci\u00e9t\u00e9 ne peut b\u00e9n\u00e9ficier des avantages sociaux<\/strong> accord\u00e9s pour les sommes qu&rsquo;elle a distribu\u00e9es \u00e0 ses salari\u00e9s en ex\u00e9cution <strong>d&rsquo;un accord de participation ant\u00e9rieurement \u00e0 son d\u00e9p\u00f4t<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6493e77a86e6f205db08ec3a?search_api_fulltext=21-18.363&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Civ. 2<sup>\u00e8me<\/sup>, 22 juin 2023, n\u00b021-18.363<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Mutuelle et dispense affiliation<\/h5>\n\n\n\n<p>La <strong>dispense<\/strong> d&rsquo;affiliation \u00e0 la <strong>mutuelle<\/strong> frais de sant\u00e9 mis en place dans l&rsquo;entreprise du salari\u00e9 n&rsquo;est <strong>pas subordonn\u00e9e \u00e0 la justification<\/strong> q<strong>u&rsquo;il b\u00e9n\u00e9ficie en qualit\u00e9 d&rsquo;ayant droit<\/strong> <strong><u>\u00e0 titre obligatoire<\/u><\/strong> de la couverture collective et obligatoire de son conjoint.<\/p>\n\n\n\n<p>La distinction entre ayant droit \u00e0 titre obligatoire et ayant droit \u00e0 titre facultatif n\u2019est donc plus de mise dans les relations salari\u00e9s\/employeur (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6480206df17e00d0f8b5729c?search_api_fulltext=21-23.743&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 7 juin 2023, n\u00b021-23.743<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Licenciement et discrimination<\/h5>\n\n\n\n<p>Si un salari\u00e9 est <strong>licenci\u00e9 apr\u00e8s avoir demand\u00e9 l\u2019organisation<\/strong> d\u2019\u00e9lections professionnelles, <strong>l\u2019employeur devra d\u00e9montrer qu\u2019il ne s\u2019agit pas d\u2019une mesure de r\u00e9torsion.<\/strong><\/p>\n\n\n\n<p>S\u2019il ne le d\u00e9montre pas et que le licenciement n\u2019est pas justifi\u00e9, il encourt la nullit\u00e9 pour discrimination syndicale (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/649be08ca10c4805db86faab?search_api_fulltext=22-11.699&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 28 juin 2023, n\u00b022-11.699<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Licenciement inaptitude<\/h5>\n\n\n\n<p><strong>L&rsquo;absence de notification<\/strong> \u00e9crite des motifs s&rsquo;opposant au reclassement du salari\u00e9 inapte d\u2019origine professionnelle <strong>fait encourir <\/strong>\u00e0 l\u2019employeur <strong>une indemnit\u00e9 en r\u00e9paration<\/strong> du pr\u00e9judice subi <strong>qui ne se cumule pas avec les dommages et int\u00e9r\u00eats pour licenciement sans cause<\/strong> <strong>r\u00e9elle et s\u00e9rieuse<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/649296c417c95e05dbf9de53?search_api_fulltext=22-10.017&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;op=Rechercher+sur+judilibre&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 21 juin 2023, n\u00b022-10.017<\/a><\/u><\/em>).<\/p>\n\n\n\n<p>En cas de <strong>licenciement pour inaptitude<\/strong> d\u2019origine professionnelle d\u2019un <strong>salari\u00e9 handicap\u00e9<\/strong>, ce dernier b\u00e9n\u00e9ficie de <strong>l\u2019indemnit\u00e9 compensatrice de pr\u00e9avis<\/strong>, <strong><u>mais pas<\/u><\/strong> de la disposition relative \u00e0 son <strong>doublement<\/strong> de l\u2019article L. 5213-9 du Code du travail <a href=\"https:\/\/www.dalloz.fr\/documentation\/Document?id=CASS_LIEUVIDE_2023-05-24_2125683\" target=\"_blank\" rel=\"noreferrer noopener\">(<em><u>Cass.
