Personnes vuln\u00e9rables<\/strong><\/h3>\n\n\n\n<p>Un d\u00e9cret a \u00e9t\u00e9 pris pr\u00e9cisant les <strong>crit\u00e8res de vuln\u00e9rabilit\u00e9<\/strong> ouvrant droit au dispositif d\u2019activit\u00e9 partielle, <strong>pour la p\u00e9riode du 1er septembre 2022 au 31 janvier 2023<\/strong>.<br>Ces crit\u00e8res sont les <strong>m\u00eames que ceux pr\u00e9c\u00e9demment fix\u00e9s <\/strong>(<em><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046497038\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cre<\/a><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046497038\">t n\u00b02022-<br>1369 du 27 octobre 2022<\/a><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Egalit\u00e9 professionnelle &#8211; Index Egalit\u00e9 Cadres Dirigeants<\/strong><\/h3>\n\n\n\n<p>Un arr\u00eat\u00e9 d\u00e9finit les modalit\u00e9s de transmission \u00e0 l&rsquo;administration des \u00e9carts \u00e9ventuels de repr\u00e9sentation entre les femmes et les hommes dans l&rsquo;entreprise parmi les cadres dirigeants et les membres des instances dirigeantes.<br>Pour rappel, ces dispositions sont applicables aux entreprises ayant au moins 1.000 salari\u00e9s (<a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046520158\" target=\"_blank\" rel=\"noreferrer noopener\">Arr\u00eat\u00e9 du 27 octobre 2022<\/a>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Paie &#8211; Frais de repas<\/strong><\/h3>\n\n\n\n<p>Les plafonds d\u2019exon\u00e9ration des frais de repas pour la p\u00e9riode du 1er septembre 2022 au 31 d\u00e9cembre 2022 ont \u00e9t\u00e9 provisoirement revaloris\u00e9s de 4 % : <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>7,10 \u20ac<\/strong> pour l\u2019indemnit\u00e9 de restauration sur le lieu de travail\u00a0;<\/li><li><strong>9,90 \u20ac<\/strong> pour l\u2019indemnit\u00e9 de restauration hors lieu de travail\u00a0;<\/li><li><strong>20,20 \u20ac<\/strong> pour les indemnit\u00e9s de repas pendant les d\u00e9placements professionnels (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046510894\" target=\"_blank\" rel=\"noreferrer noopener\">Arr\u00eat\u00e9 du 24 octobre 2022<\/a><\/u><\/em>).<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Paie &#8211; Frais de t\u00e9l\u00e9travail et NTIC<\/strong><\/h3>\n\n\n\n<p>Reconnaissance l\u00e9gale de l\u2019exon\u00e9ration d\u2019une <strong>allocation forfaitaire de remboursement de frais du t\u00e9l\u00e9travail<\/strong> \u00e0 hauteur de <strong>10 \u20ac par mois<\/strong> <strong>par journ\u00e9e de t\u00e9l\u00e9travail<\/strong> <strong>hebdomadaire<\/strong>, <strong>ou 2,50 \u20ac par mois par jour de t\u00e9l\u00e9travail<\/strong>, <strong>dans la limite de 55 \u20ac<\/strong>.<\/p>\n\n\n\n<p>Les <strong>frais d\u2019utilisation des outils NTIC<\/strong> peuvent aussi \u00eatre rembours\u00e9s forfaitairement et exon\u00e9r\u00e9s dans la <strong>limite de 50 \u20ac par mois<\/strong> en cas de justificatif d\u2019utilisation pour raisons professionnelles (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046510894\" target=\"_blank\" rel=\"noreferrer noopener\">Arr\u00eat\u00e9 du 24 octobre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Paie &#8211; Arr\u00eat de travail et maternit\u00e9<\/strong><\/h3>\n\n\n\n<p><strong>Report au 1<sup>er<\/sup> juin 2024<\/strong> des <strong>nouvelles<\/strong> <strong>r\u00e8gles de calcul<\/strong> des <strong>IJSS<\/strong> maladie et maternit\u00e9 en cas de p\u00e9riode de r\u00e9f\u00e9rence incompl\u00e8te (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046432511#:~:text=dol%2C%20majeurs%20prot%C3%A9g%C3%A9s-,D%C3%A9cret%20n%C2%B0%202022%2D1326%20du%2014%20octobre%202022%20modifiant,indemnit%C3%A9s%20journali%C3%A8res%20maladie%20et%20maternit%C3%A9\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1326 du 14 octobre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>D\u00e9tachement &#8211; Transport<\/strong><\/h3>\n\n\n\n<p>Un d\u00e9cret modifie les dispositions du Code du travail et du transport conform\u00e9ment \u00e0 la nouvelle l\u00e9gislation, \u00e0 compter du 1<sup>er<\/sup> janvier 2023.<\/p>\n\n\n\n<p>Il <strong>supprime l&rsquo;attestation de d\u00e9tachement<\/strong> des salari\u00e9s roulant ou navigant dans le domaine du transport, sauf en cas de d\u00e9tachement de salari\u00e9 roulant r\u00e9alis\u00e9 dans le cadre d&rsquo;une prestation de services internationale au moyen d&rsquo;un v\u00e9hicule de transport l\u00e9ger (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046474061\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1346 du 21 octobre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ch\u00f4mage &#8211; P\u00f4le Emploi<\/strong><\/h3>\n\n\n\n<p>Un d\u00e9cret <strong>prolonge jusqu\u2019au 31 janvier 2023 l\u2019application<\/strong> <strong>des actuelles r\u00e8gles<\/strong> d\u2019indemnisation de l\u2019assurance ch\u00f4mage et le dispositif du bonus-malus (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046503431#:~:text=dol%2C%20majeurs%20prot%C3%A9g%C3%A9s-,D%C3%A9cret%20n%C2%B0%202022%2D1374%20du%2029%20octobre%202022%20prorogeant,du%20r%C3%A9gime%20d'assurance%20ch%C3%B4mage&amp;text=Recherche%20simple%20dans%20le%20code%20Rechercher%20dans%20le%20texte...&amp;text=Publics%20concern%C3%A9s%20%3A%20demandeurs%20d'emploi,l'assurance%20ch%C3%B4mage%20%3B%20entreprises.\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1374 du 29 octobre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><strong>Actualit\u00e9s jurisprudentielles<\/strong><\/h1>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ex\u00e9cution du contrat &#8211; Egalit\u00e9 de traitement<\/strong><\/h3>\n\n\n\n<p>Constitue une justification objective et pertinente \u00e0 une <strong>diff\u00e9rence de traitement<\/strong> la volont\u00e9 de l\u2019employeur de <strong>r\u00e9duire les disparit\u00e9s<\/strong> entre des salari\u00e9s dont les contrats de travail se sont poursuivis sur un site et ceux recrut\u00e9s post\u00e9rieurement sur le m\u00eame site, et plac\u00e9s dans une situation identique (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000046510457?cassDecision=ARRET&amp;cassFormation=CHAMBRE_SOCIALE&amp;init=true&amp;isAdvancedResult=true&amp;juridictionJudiciaire=Cour+de+cassation&amp;page=1&amp;pageSize=10&amp;query=%7B%28%40ALL%5Bt%22*%22%5D%29%7D&amp;sortValue=DATE_DESC&amp;tab_selection=juri&amp;typeRecherche=date\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc. 26 octobre 2022, n\u00b021-10.803<\/a><\/u><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ex\u00e9cution du contrat &#8211; Sant\u00e9 et s\u00e9curit\u00e9<\/strong><\/h3>\n\n\n\n<p>Il est possible de <strong>contester<\/strong> devant le Conseil de prud\u2019hommes selon la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond <strong>le revirement de position du M\u00e9decin du travail qui annule des propositions d\u2019am\u00e9nagement temporaire du poste<\/strong> de travail prises dans l\u2019attente d\u2019examens m\u00e9dicaux (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000046510444?init=true&amp;page=1&amp;query=21-17.484&amp;searchField=ALL&amp;tab_selection=all\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 26 octobre 2022, n\u00b021-17.484<\/a><\/u><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Dur\u00e9e du travail &#8211; Temps partiel<\/strong><\/h3>\n\n\n\n<p>Les associations et entreprises <strong>d\u2019aide \u00e0 domicile<\/strong> peuvent se limiter \u00e0 mentionner <strong>dans les contrats \u00e0 temps partiel<\/strong> <strong>uniquement la dur\u00e9e hebdomadaire ou mensuelle de travail<\/strong>. Elles n\u2019ont pas l\u2019obligation d\u2019indiquer la r\u00e9partition de la dur\u00e9e du travail entre les jours de la semaine, ou les semaines du mois (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000046510445?init=true&amp;page=1&amp;query=20-23.209&amp;searchField=ALL&amp;tab_selection=all\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 26 octobre 2022, n\u00b020-23.209<\/a><\/u><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Dur\u00e9e du travail &#8211; Astreinte<\/strong><\/h3>\n\n\n\n<p><strong>L\u2019intensit\u00e9 des contraintes<\/strong> du salari\u00e9 <strong>pendant<\/strong> ses p\u00e9riodes d\u2019<strong>astreinte<\/strong> (court d\u00e9lai d\u2019intervention, obligation de rester \u00e0 proximit\u00e9 des locaux) peut <strong>affecter<\/strong> sa facult\u00e9 de <strong>vaquer \u00e0 ses occupations personnelles<\/strong>, et constituer du <strong>temps de travail effectif<\/strong>, r\u00e9mun\u00e9r\u00e9 comme tel. (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6358d00a99f67905a719f96b?judilibre_juridiction=cc&amp;judilibre_chambre%5B0%5D=soc&amp;previousdecisionpage=0&amp;previousdecisionindex=4&amp;nextdecisionpage=0&amp;nextdecisionindex=6\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 26 octobre 2022, n\u00b021-14.178<\/a><\/u><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Dur\u00e9e du travail &#8211; Repos dominical<\/strong><\/h3>\n\n\n\n<p>Un <strong>arr\u00eat\u00e9 pr\u00e9fectoral<\/strong> peut pr\u00e9voir la <strong>fermeture<\/strong> \u00e0 la client\u00e8le le <strong>dimanche<\/strong> des <strong>magasins d\u2019alimentation<\/strong>, sauf si les modalit\u00e9s de fonctionnement et de paiement sont automatis\u00e9es.<\/p>\n\n\n\n<p>Les <strong>agents de surveillance b\u00e9n\u00e9ficient d\u2019une autre d\u00e9rogation au repos dominical<\/strong>.<\/p>\n\n\n\n<p>Les <strong>magasins d\u2019alimentation<\/strong> ayant des modalit\u00e9s de fonctionnement automatis\u00e9s, avec des <strong>agents de surveillance ne participant pas au fonctionnement<\/strong> du magasin (rangement, conseil \u00e0 la client\u00e8le, assistance aux caisses) ne sont <strong>pas concern\u00e9s<\/strong> par l\u2019arr\u00eat\u00e9 Pr\u00e9fectoral de fermeture (<em><u><a href=\"https:\/\/www.courdecassation.fr\/en\/decision\/6358d00b99f67905a719f96d\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 26 octobre 2022, n\u00b021-15.142<\/a><\/u><\/em>)<\/p>\n\n\n\n<p>A contrario, <strong>si les agents<\/strong> <strong>de surveillance participent aux activit\u00e9s du magasin, l\u2019arr\u00eat\u00e9<\/strong> pr\u00e9fectoral de fermeture <strong>s\u2019impose<\/strong> aux magasins d\u2019alimentation, m\u00eame si lesdits agents sont embauch\u00e9s par une entreprise prestataire de services (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/6358d00d99f67905a719f96f\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 26 octobre 2022, n\u00b021-19.075<\/a><\/u><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Rupture du contrat<\/strong> &#8211; <strong>Licenciement &#8211; Harc\u00e8lement<\/strong><\/h3>\n\n\n\n<p>Le licenciement d\u2019un salari\u00e9 pour avoir relat\u00e9 des faits de harc\u00e8lement moral, sans \u00e9tablir sa mauvaise foi, est nul.<\/p>\n\n\n\n<p>Cette mauvaise foi ne peut reposer seulement sur la seule circonstance que les faits de harc\u00e8lement ne seraient pas \u00e9tablis (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000046480868?init=true&amp;page=1&amp;query=21-16.361&amp;searchField=ALL&amp;tab_selection=all\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 19 octobre 2022, n\u00b021-16.361<\/a><\/u><\/em>).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Rupture du contrat &#8211; Licenciement &#8211; Neutralit\u00e9<\/strong><\/h3>\n\n\n\n<p>Le <strong>salari\u00e9<\/strong> de droit priv\u00e9 d\u2019une <strong>mission locale<\/strong>, mis \u00e0 disposition d\u2019une collectivit\u00e9 publique, est soumis au <strong>principe de neutralit\u00e9<\/strong>. Il a donc une <strong>obligation de r\u00e9serve<\/strong> en dehors de l\u2019exercice de ses fonctions. Les commentaires contraires \u00e0 ce principe \u00e9mis publiquement sur Facebook peuvent justifier son <strong>licenciement<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000046480768?init=true&amp;page=1&amp;query=21-12.370&amp;searchField=ALL&amp;tab_selection=all\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 29 octobre 2022, n\u00b021-12.370<\/a><\/u><\/em>)<em>.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Repr\u00e9sentant du personnel &#8211; Accord de participation<\/strong><\/h3>\n\n\n\n<p>Le CSE ne peut pas contester la l\u00e9galit\u00e9 de la clause d\u2019un accord de participation qu\u2019il a lui-m\u00eame sign\u00e9 avec l\u2019employeur (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000046480752?init=true&amp;page=1&amp;query=21-15.270&amp;searchField=ALL&amp;tab_selection=all\" target=\"_blank\" rel=\"noreferrer noopener\">Cass.
