(<em><u><a href=\"https:\/\/boss.gouv.fr\/portail\/accueil\/actualites-boss\/2022\/novembre\/extinction-du-regime-social-prov.html\" target=\"_blank\" rel=\"noreferrer noopener\">Communiqu\u00e9 publi\u00e9 au BOSS le 28 novembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Ex\u00e9cution du contrat &#8211; Dossier M\u00e9dical<\/strong><\/h5>\n\n\n\n<p>Le dossier m\u00e9dical en sant\u00e9 au travail doit \u00eatre constitu\u00e9 sous format num\u00e9rique s\u00e9curis\u00e9 par le Service de sant\u00e9 au travail conform\u00e9ment au RGPD, avec l\u2019obligation de mentionner plusieurs informations, et pi\u00e8ces.<\/p>\n\n\n\n<p>Le dossier m\u00e9dical est conserv\u00e9 pendant 40 ans \u00e0 compter de la date de la derni\u00e8re visite ou du dernier examen, ou dans la limite de 10 ans \u00e0 compter du d\u00e9c\u00e8s du titulaire du dossier. Le travailleur peut demander la copie de son dossier sous format papier ou d\u00e9mat\u00e9rialis\u00e9, et exercer ses droits de rectification, d\u2019effacement et de limitation conform\u00e9ment au RGPD (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046562060\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1434 du 15 novembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Paie &#8211; Indemnit\u00e9 inflation<\/strong><\/h5>\n\n\n\n<p>Depuis le 25 mars 2022, les personnes qui n\u2019avaient pas encore re\u00e7u l\u2019indemnit\u00e9 inflation pouvaient en faire la demande via un t\u00e9l\u00e9service \u00ab Mes Droits Sociaux \u00bb. Ce t\u00e9l\u00e9service est ferm\u00e9 depuis le 1er d\u00e9cembre 2022. Les personnes \u00e9ligibles au dispositif qui n\u2019auraient pas encore r\u00e9clam\u00e9 l\u2019indemnit\u00e9 doivent d\u00e9sormais s\u2019adresser directement \u00e0 leur employeur ou aux organismes charg\u00e9s de son versement. Ces derniers leur verseront l\u2019indemnit\u00e9 selon les r\u00e8gles qui leur sont applicables (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046663634\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1490 du 30 novembre 2022<\/a>)<\/u><\/em>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Paie &#8211; Heures suppl\u00e9mentaires<\/strong><\/h5>\n\n\n\n<p>Le montant de la d\u00e9duction forfaitaire des cotisations patronales au titre des heures suppl\u00e9mentaires pour les entreprises de 20 \u00e0 250 salari\u00e9s est de 0,50 \u20ac par heure suppl\u00e9mentaire. Il est applicable au titre des heures suppl\u00e9mentaires r\u00e9alis\u00e9es \u00e0 compter du 1er octobre 2022 (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046677235\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1506 du 1er d\u00e9cembre 2022<\/a><\/u>)<\/em>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Paie &#8211; Bonus\/Malus Ch\u00f4mage<\/strong><\/h5>\n\n\n\n<p>Les taux de s\u00e9paration m\u00e9dians par secteur sont modifi\u00e9s \u00e0 compter du 1<sup>er<\/sup> d\u00e9cembre 2022, pour calculer la modulation des contributions patronales des employeurs des 7 secteurs concern\u00e9s (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046588793\" target=\"_blank\" rel=\"noreferrer noopener\">Arr\u00eat\u00e9 du 17 novembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>ACTUALITES JURISPRUDENTIELLES<\/strong><\/h2>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Formation du contrat &#8211; CDD<\/strong><\/h5>\n\n\n\n<p>Le d\u00e9lai de prescription de l\u2019action en requalification d\u2019un CDD de remplacement pour d\u00e9faut de mention du nom et de la qualification professionnelle dans le contrat court \u00e0 compter de la date de conclusion du contrat (<em><a href=\"https:\/\/www.courdecassation.fr\/en\/decision\/637dcb5c14982305d4c204d8\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 23 novembre 2022, n\u00b021-13.059<\/a><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Ex\u00e9cution du contrat &#8211; Discrimination<\/strong><\/h5>\n\n\n\n<p>L\u2019interdiction faite \u00e0 un salari\u00e9 de porter une <strong>coiffure<\/strong>, pourtant autoris\u00e9e par le m\u00eame r\u00e9f\u00e9rentiel pour le personnel f\u00e9minin, caract\u00e9rise une <strong>discrimination<\/strong> directement fond\u00e9e sur <strong>l\u2019apparence physique<\/strong> en lien avec le <strong>sexe<\/strong>.<\/p>\n\n\n\n<p>La perception sociale de l\u2019apparence physique des genres masculin et f\u00e9minin ne peut constituer une exigence professionnelle v\u00e9ritable et d\u00e9terminante justifiant une diff\u00e9rence de traitement relative \u00e0 la coiffure entre les femmes et les hommes (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/637dcb6914982305d4c204e0?search_api_fulltext=21-14.060&amp;op=Rechercher+sur+judilibre&amp;date_du=&amp;date_au=&amp;judilibre_juridiction=cc&amp;judilibre_chambre%5B%5D=soc&amp;previousdecisionpage=&amp;previousdecisionindex=&amp;nextdecisionpage=&amp;nextdecisionindex=\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc. 23 novembre 2022, n\u00b021-14.060<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Ex\u00e9cution du contrat &#8211; Harc\u00e8lement<\/strong><\/h5>\n\n\n\n<p>Le juge du fond peut d\u00e9bouter une salari\u00e9e de sa demande au titre d\u2019un harc\u00e8lement sexuel d\u00e8s lors qu\u2019elle constate que le dirigeant de la soci\u00e9t\u00e9 a \u00e9mis une remarque inappropri\u00e9e sur son physique et retenu que, si de tels propos n\u2019\u00e9taient pas admissibles, ils ne faisaient pas ressortir chez leur auteur la volont\u00e9 d\u2019obtenir des faveurs de nature sexuelle. Soc., 23 novembre 2022, n\u00b021-18.726<\/a>)<\/u><\/em>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Ex\u00e9cution du contrat &#8211; Modification du contrat<\/strong><\/h5>\n\n\n\n<p>Si le salari\u00e9 a tacitement accept\u00e9 la modification de son contrat de travail pour motif \u00e9conomique, il ne peut invoquer la nullit\u00e9 de cette mesure, m\u00eame si le PSE au sein de l\u2019entreprise est par la suite annul\u00e9 (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/637dcb4414982305d4c204ca\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 23 novembre 2022, n\u00b021-16.162<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Dur\u00e9e du travail &#8211; Forfait jours<\/strong><\/h5>\n\n\n\n<p>L\u2019employeur a l\u2019obligation de mettre en place les m\u00e9canismes permettant de veiller au respect des temps de repos quotidien et hebdomadaire des salari\u00e9s en forfait jours. A d\u00e9faut, la convention de forfait-jours est jug\u00e9e nulle, et le salari\u00e9 peut solliciter un rappel de salaire au titre des heures suppl\u00e9mentaires. Soc., 9 novembre 2022, n\u00b021-13.389<\/a>)<\/u><\/em>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Dur\u00e9e du travail &#8211; Salari\u00e9s itin\u00e9rants<\/strong><\/h5>\n\n\n\n<p>Un salari\u00e9 qui, lors de ses temps de <strong>d\u00e9placement entre son domicile et les sites des premiers et derniers clients<\/strong>, devait <strong>rester \u00e0 disposition<\/strong> via un son t\u00e9l\u00e9phone portable professionnel et un kit main libre pour fixer des rendez-vous, r\u00e9pondre \u00e0 ses interlocuteurs, et exercer ses fonctions <strong>se conforme aux directives<\/strong> de son employeur <strong>sans pouvoir vaquer \u00e0 ses occupations personnelles<\/strong>.<\/p>\n\n\n\n<p>Ce temps de d\u00e9placement doit donc \u00eatre consid\u00e9r\u00e9 comme du <strong>temps de travail effectif<\/strong>, et r\u00e9mun\u00e9r\u00e9 comme tel (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/637dcb6714982305d4c204de\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 23 novembre 2022, n\u00b020-21.924<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Rupture du contrat &#8211; Licenciement et libert\u00e9 d\u2019expression<\/strong><\/h5>\n\n\n\n<p>Le licenciement pour insuffisance professionnelle d\u2019un salari\u00e9 Directeur pour avoir refus\u00e9 de participer aux valeurs \u00ab?<em>fun and pro<\/em>?\u00bb et \u00e0 la \u00ab?<em>culture de l\u2019ap\u00e9ro<\/em>?\u00bb pr\u00f4n\u00e9es par son entreprise est une violation de sa libert\u00e9 d\u2019expression, et est donc consid\u00e9r\u00e9 comme nul. Soc., 9 novembre 2022, n\u00b021-15.208<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Rupture du contrat &#8211; Licenciement et inaptitude<\/strong><\/h5>\n\n\n\n<p>L\u2019employeur n\u2019a pas \u00e0 consulter le CSE si l\u2019avis d\u2019inaptitude dispense l\u2019employeur de rechercher un reclassement (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/63748dfb40f124dcd102fbe8\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 16 novembre 2022, n\u00b021-17.255<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Rupture du contrat &#8211; Licenciement et situation irr\u00e9guli\u00e8re d\u2019un \u00e9tranger<\/strong><\/h5>\n\n\n\n<p>Le licenciement d\u2019un salari\u00e9 \u00e9tranger du fait de sa situation irr\u00e9guli\u00e8re n\u2019est pas un licenciement disciplinaire, mais bien un motif de rupture distinct, excluant les dispositions du licenciement et l\u2019allocation de dommages et int\u00e9r\u00eats.<\/p>\n\n\n\n<p>Le licenciement pour faute grave \u00e9nonc\u00e9 en ce sens est donc sans cause r\u00e9elle et s\u00e9rieuse.
