{"id":992,"date":"2023-01-13T16:16:42","date_gmt":"2023-01-13T15:16:42","guid":{"rendered":"https:\/\/chaixavocat.com\/?p=992"},"modified":"2023-04-12T16:22:52","modified_gmt":"2023-04-12T15:22:52","slug":"flashactu-n12-actualites-sociales-decembre-2022","status":"publish","type":"post","link":"https:\/\/chaixavocat.com\/index.php\/2023\/01\/13\/flashactu-n12-actualites-sociales-decembre-2022\/","title":{"rendered":"Flash\u2019Actu n\u00b012 : Actualit\u00e9s sociales D\u00e9cembre 2022"},"content":{"rendered":"<a href=\"https:\/\/chaixavocat.com\/wp-content\/uploads\/2023\/01\/CHAIX-AVOCAT-Flash-actu-sociale-12.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"bottom\" data-toolbar-fixed=\"off\">CHAIX-AVOCAT-Flash-actu-sociale-12<\/a>\n<p class=\"wp-block-pdfemb-pdf-embedder-viewer\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>ACTUALITES LEGALES ET REGLEMENTAIRES<\/strong><\/h2>\n\n\n\n<h5 class=\"wp-block-heading\">Formation du contrat &#8211; CDD<\/h5>\n\n\n\n<p>Le <strong>CDD tremplin<\/strong>, qui permet aux personnes handicap\u00e9es de b\u00e9n\u00e9ficier d\u2019un parcours de remis \u00e0 l\u2019emploi, de qualification, et de construction d&rsquo;un parcours les amenant \u00e0 retrouver un emploi, est <strong>prolong\u00e9 jusqu\u2019au 31 d\u00e9cembre 2023<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046845863\" target=\"_blank\" rel=\"noreferrer noopener\">Article 210 de la loi de finance pour 2023 n\u00b02022-1726 du 30 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Formation du contrat &#8211; CDD et int\u00e9rim<\/h5>\n\n\n\n<p>Possibilit\u00e9 <strong>jusqu\u2019au 21 d\u00e9cembre 2024<\/strong> pour les <strong>entreprises de certains secteurs de conclure un seul CDD<\/strong> ou contrat <strong>d\u2019int\u00e9rim<\/strong> pour <strong>remplacer<\/strong> <strong>plusieurs salari\u00e9s absents<\/strong>, soit simultan\u00e9ment, soit successivement (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046771787\" target=\"_blank\" rel=\"noreferrer noopener\">Article 6 de la Loi n\u00b02022-1598 du 21 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<p>Obligation pour l\u2019employeur <strong>d\u2019informer P\u00f4le Emploi en cas de refus par le salari\u00e9 d\u2019une proposition de CDI<\/strong>&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>s\u2019il est en <strong><u>CDD<\/u><\/strong>&nbsp;: en cas de refus d\u2019un <strong>poste \u00e9quivalent<\/strong> (r\u00e9mun\u00e9ration, lieu de travail, classification et dur\u00e9e du travail)&nbsp;;<\/li>\n\n\n\n<li>s\u2019il est en <strong><u>int\u00e9rim<\/u><\/strong>&nbsp;: en cas de refus d\u2019un poste similaire <strong>sans changement de lieu de travail.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>La proposition de CDI devra \u00eatre faite par \u00e9crit. L\u2019entr\u00e9e en vigueur de cette disposition n\u00e9cessite la parution d\u2019un D\u00e9cret (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046771783\" target=\"_blank\" rel=\"noreferrer noopener\">Article 2 de la Loi n\u00b02022-1598 du 21 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Formation du contrat &#8211; CDI int\u00e9rimaire<\/h5>\n\n\n\n<p><strong>Suppression de la dur\u00e9e maximale des missions<\/strong> d\u2019int\u00e9rim r\u00e9alis\u00e9es dans le cadre d\u2019un CDI int\u00e9rimaire, qui \u00e9tait fix\u00e9e \u00e0 36 mois (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046771788\" target=\"_blank\" rel=\"noreferrer noopener\">Article 7 de la Loi n\u00b02022-1598 du 21 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Activit\u00e9 partielle &#8211; COVID 19<\/h5>\n\n\n\n<p>Le <strong>taux horaire minimum de l\u2019allocation<\/strong> au titre de l\u2019activit\u00e9 partielle est relev\u00e9 \u00e0 <strong>8,03 \u20ac<\/strong> \u00e0 compter du 1<sup>er<\/sup> janvier 2023.<\/p>\n\n\n\n<p>De m\u00eame, le taux horaire minimum de l\u2019allocation sera de <strong>8,92 \u20ac<\/strong> pour les employeurs des <strong>personnes vuln\u00e9rables<\/strong> au Covid-19 ne pouvant pas travailler, <strong>ou<\/strong> les employeurs b\u00e9n\u00e9ficiant de <strong>l\u2019APLD<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046792821\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1632 du 22 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Passeport pr\u00e9vention<\/h5>\n\n\n\n<p>Les modalit\u00e9s de mise en \u0153uvre du passeport de pr\u00e9vention et de mise \u00e0 disposition de l\u2019employeur sont parues.<\/p>\n\n\n\n<p>Pour rappel, l\u2019ouverture du passeport de pr\u00e9vention des travailleurs est pr\u00e9vue pour avril 2023.<\/p>\n\n\n\n<p>Le salari\u00e9 pourra notamment <strong>autoriser l\u2019employeur d\u2019acc\u00e9der totalement ou partiellement \u00e0 son passeport de pr\u00e9vention<\/strong>.<\/p>\n\n\n\n<p>Les modalit\u00e9s de demande de cet accord seront fix\u00e9es par arr\u00eat\u00e9 \u00e0 paraitre.<\/p>\n\n\n\n<p><strong>L\u2019organisme de formation externe<\/strong> \u00e0 l\u2019entreprise devra <strong>alimenter<\/strong> le <strong>passeport de pr\u00e9vention du titulaire <\/strong>pour la formation qu&rsquo;il aura assur\u00e9e.<\/p>\n\n\n\n<p>L\u2019organisme de formation devra alors <strong>informer l\u2019employeur par tout moyen<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046837251\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1712 du 29 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Compte Personnel de Formation<\/h5>\n\n\n\n<p>Le titulaire du CPF devra imp\u00e9rativement participer au financement de sa formation. Il aura donc un <strong>reste \u00e0 charge<\/strong>, ce qui n\u2019\u00e9tait pas le cas auparavant.<\/p>\n\n\n\n<p>Le reste \u00e0 charge ne concernera pas les demandeurs d\u2019emploi ni les salari\u00e9s en cas d\u2019un projet co-construit avec l\u2019employeur.<\/p>\n\n\n\n<p>Un d\u00e9cret, non paru, devra fixer les modalit\u00e9s de la participation du titulaire (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046845745\" target=\"_blank\" rel=\"noreferrer noopener\">Article 107 de la loi de finance pour 2023 n\u00b02022-1726 du 30 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Arr\u00eats maladie COVID 19<\/h5>\n\n\n\n<p>Le <strong>dispositif d\u00e9rogatoire des arr\u00eats maladie<\/strong> pour <strong>COVID-19<\/strong> est <strong>reconduit jusqu\u2019au 31 d\u00e9cembre 2023 au plus tard<\/strong>, pour les assur\u00e9s test\u00e9s positifs au COVID-19 et devant s\u2019isoler sans pouvoir travailler.<\/p>\n\n\n\n<p>Les m\u00eames modalit\u00e9s d\u00e9rogatoires s\u2019appliquent (pas de d\u00e9lai de carence, p\u00e9riode d\u2019indemnisation non prise en compte, droit \u00e0 un maintien de salaire l\u00e9gal employeur) (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046791814\" target=\"_blank\" rel=\"noreferrer noopener\">Article 27 de la LFSS 2023 n\u00b02022-1616 du 22 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Heures suppl\u00e9mentaires et RTT<\/h5>\n\n\n\n<p>Les modalit\u00e9s d\u2019imputation de la d\u00e9duction forfaitaire dans les entreprises de 20 \u00e0 moins de 250 salari\u00e9s sont calqu\u00e9es sur celles applicables dans les entreprises de moins de 20 salari\u00e9s.<\/p>\n\n\n\n<p>Cette <strong>d\u00e9duction<\/strong> <strong>s\u2019impute<\/strong> d\u00e9sormais <strong>sur les cotisations dues par l\u2019employeur au titre de l&rsquo;ensemble de la r\u00e9mun\u00e9ration<\/strong> <strong>vers\u00e9e au salari\u00e9<\/strong> au moment du paiement de la dur\u00e9e de travail suppl\u00e9mentaire.<\/p>\n\n\n\n<p>Il <strong>en est de m\u00eame pour les jours RTT mon\u00e9tis\u00e9s<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046791785\" target=\"_blank\" rel=\"noreferrer noopener\">Article 22 de la loi n\u00b02022-1616 de financement de la s\u00e9curit\u00e9 sociale pour 2023 du 23 d\u00e9cembre 2022<\/a><\/u>)<\/em>.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Titres Restaurants<\/h5>\n\n\n\n<p>A compter du 1<sup>er<\/sup> janvier 2023, le <strong>plafond d&rsquo;exon\u00e9ration<\/strong> de la participation patronale aux titres-restaurants s&rsquo;\u00e9l\u00e8vera \u00e0 <strong>6,50 euros<\/strong> (5,92 \u20ac en 2022) (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046845642\" target=\"_blank\" rel=\"noreferrer noopener\">Article 4 de la loi de finance pour 2023 n\u00b02022-1726 du 30 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Epargne salariale<\/h5>\n\n\n\n<p>La loi de finance pour 2021 avait pr\u00e9vu que les <strong>abondements patronaux<\/strong> compl\u00e9tant les versements volontaires du salari\u00e9 <strong>pour l\u2019acquisition de titres de l\u2019entreprise<\/strong> ne seraient <strong>pas assujettis de forfait social <\/strong>pour 2021 et 2022.<\/p>\n\n\n\n<p>Cette mesure est <strong>reconduite<\/strong> pour 2023 (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046845745\" target=\"_blank\" rel=\"noreferrer noopener\">Article 107 de la loi de finance pour 2023 n\u00b02022-1726 du 30 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Apprentissage et professionnalisation<\/h5>\n\n\n\n<p><strong>L\u2019aide exceptionnelle<\/strong> pour l\u2019embauche de jeunes en apprentissage ou professionnalisation est <strong>prolong\u00e9e<\/strong> pour les contrats conclus entre le 1<sup>er<\/sup> janvier 2023 et le 31 d\u00e9cembre 2023.<\/p>\n\n\n\n<p>Son montant maximum, vers\u00e9 uniquement la 1<sup>\u00e8re<\/sup> ann\u00e9e, sera de <strong>6.000 \u20ac<\/strong> (contre&nbsp;8.000 \u20ac auparavant) (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046837282\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1714 du 29 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; AT\/MP<\/h5>\n\n\n\n<p>La <strong>majoration forfaitaire<\/strong> <strong>du taux collectif <\/strong>AT\/MP devant s\u2019appliquer pour les entreprises de + 10 salari\u00e9s qui<\/p>\n\n\n\n<p>ont eu au moins un arr\u00eat pour accident du travail sur chacune des 3 derni\u00e8res ann\u00e9es est <strong>report\u00e9e au 1<sup>er<\/sup> janvier 2024<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000046793977\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02022-1644 du 23 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Repr\u00e9sentant du personnel &#8211; Elections professionnelles<\/h5>\n\n\n\n<p>Inclusion des <strong>salari\u00e9s assimil\u00e9s \u00e0 l\u2019employeu<\/strong>r dans les <strong>listes \u00e9lectorales<\/strong> des \u00e9lections du CSE, et maintien de leur exclusion d\u2019\u00e9ligibilit\u00e9.<\/p>\n\n\n\n<p>Application r\u00e9troactive \u00e0 compter du <strong>31 octobre 2022<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046771789\" target=\"_blank\" rel=\"noreferrer noopener\">Article 8 de la Loi n\u00b02022-1598 du 21 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Travail dissimul\u00e9 &#8211; Donneur d\u2019ordre<\/h5>\n\n\n\n<p>Variation des sanctions du <strong>donneur d\u2019ordre<\/strong> soumis \u00e0 une obligation de vigilance, en fonction de situation de r\u00e9cidive ou non.<\/p>\n\n\n\n<p><strong>En cas de 1<sup>er<\/sup> manquement<\/strong>, la sanction est plafonn\u00e9e \u00e0 15.000 \u20ac pour une personne physique (75.000 \u20ac pour une personne morale)&nbsp;;<\/p>\n\n\n\n<p><strong>En cas de r\u00e9it\u00e9ration dans les 5 ans, ces plafonds ne s\u2019appliquent plus.<\/strong><\/p>\n\n\n\n<p>Le donneur d\u2019ordre fautif peut aussi b\u00e9n\u00e9ficier d\u2019une r\u00e9duction de 10 points du taux de la majoration en cas de r\u00e8glement dans les 30 jours \u00e0 compter de la mise en demeure (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046791769\" target=\"_blank\" rel=\"noreferrer noopener\">Article 6 de la LFSS 2023 n\u00b02022-1616 du 22 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">P\u00f4le Emploi &#8211; Dur\u00e9e indemnisation<\/h5>\n\n\n\n<p>La <strong>dur\u00e9e d\u2019indemnisation<\/strong> pourra \u00eatre <strong>modul\u00e9e par le Gouvernement<\/strong> en fonction de l\u2019\u00e9tat du march\u00e9 du travail (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046771782\" target=\"_blank\" rel=\"noreferrer noopener\">Article 1 de la Loi n\u00b02022-1598 du 21 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">P\u00f4le Emploi &#8211; Exclusion allocation ch\u00f4mage<\/h5>\n\n\n\n<p><strong>Exclusion<\/strong> du b\u00e9n\u00e9fice des allocations ch\u00f4mage du demandeur d&#8217;emploi <strong>en cas de 2 refus d&rsquo;offres d&#8217;emploi en CDI<\/strong> au terme d&rsquo;un <strong>CDD<\/strong> ou d\u2019un contrat <strong>d\u2019int\u00e9rim<\/strong> <strong>sur les 12 derniers mois pour un emploi identique ou similaire<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046771783\" target=\"_blank\" rel=\"noreferrer noopener\">Article 2 de la Loi n\u00b02022-1598 du 21 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<p><strong>Pr\u00e9somption de d\u00e9mission <\/strong>et donc exclusion du b\u00e9n\u00e9fice des allocations ch\u00f4mage en cas<strong> d\u2019abandon de poste et d\u2019absence de reprise de travail apr\u00e8s mise en demeure <\/strong>de l\u2019employeur <strong>dans un d\u00e9lai minimal fix\u00e9 par d\u00e9cret \u00e0 paraitre.<\/strong><\/p>\n\n\n\n<p>Le salari\u00e9 pourra<strong> contester la rupture <\/strong>de son contrat de travail<strong> devant le Conseil de prud\u2019hommes, qui pourra consid\u00e9rer que le licenciement est injustifi\u00e9 <\/strong>(<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046771785\" target=\"_blank\" rel=\"noreferrer noopener\">Article 4 de la Loi n\u00b02022-1598 du 21 d\u00e9cembre 2022<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">P\u00f4le Emploi &#8211; Bonus &#8211; Malus<\/h5>\n\n\n\n<p>Possibilit\u00e9 pour le Gouvernement de pr\u00e9voir la <strong>prolongation jusqu\u2019au 31 ao\u00fbt 2024<\/strong> du dispositif Bonus-Malus de la contribution d\u2019assurance ch\u00f4mage de l\u2019employeur pour les entreprises de 11 salari\u00e9s et + dans 7 secteurs d\u2019activit\u00e9 (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/article_jo\/JORFARTI000046771782\" target=\"_blank\"
