Formation<\/h5>\n\n\n\n<p>Pour rappel, une loi du 3 juillet 2020 a mis en place <strong>l\u2019obligation de proposer aux salari\u00e9s, avant leur d\u00e9part \u00e0 la retraite, une formation de sensibilisation sur les gestes de premiers secours.<\/strong><\/p>\n\n\n\n<p>La liste des personnes autoris\u00e9es \u00e0 dispenser cette sensibilisation vient de paraitre par Arr\u00eat\u00e9.<\/p>\n\n\n\n<p>Ce sont les formateurs, associations, organismes et professionnels qui peuvent aussi faire des formations \u00ab&nbsp;<em>aux gestes qui sauvent<\/em>&nbsp;\u00bb (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047017735\" target=\"_blank\" rel=\"noreferrer noopener\">Arr\u00eat\u00e9 du 7 septembre 2022 paru le 22 janvier 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Bulletin de paie<\/h5>\n\n\n\n<p>Un Arr\u00eat\u00e9 rend obligatoire la mention du \u00ab&nbsp;<strong><em>montant net social<\/em><\/strong>&nbsp;\u00bb sur le bulletin de salaire, qui est le revenu net apr\u00e8s d\u00e9duction de l\u2019ensemble des pr\u00e9l\u00e8vements sociaux obligatoires, et excluant notamment le remboursement de frais professionnels.<\/p>\n\n\n\n<p>Il <strong>se substituera au \u00ab&nbsp;<em>montant net vers\u00e9&nbsp;<\/em>\u00bb \u00e0 compter du 1<sup>er<\/sup> juillet 2023<\/strong>.<\/p>\n\n\n\n<p>De m\u00eame, un nouveau mod\u00e8le de structure du bulletin de paie est pr\u00e9vu, avec une date d\u2019effet obligatoire \u00e0 compter du 1<sup>er<\/sup> janvier 2025 (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047096915\" target=\"_blank\" rel=\"noreferrer noopener\">Arr\u00eat\u00e9 du 31 janvier 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Partage de la valeur<\/h5>\n\n\n\n<p>Un Accord national interprofessionnel sur le partage de la valeur au sein de l\u2019entreprise a \u00e9t\u00e9 mis en place.<\/p>\n\n\n\n<p>Est notamment pr\u00e9vue l\u2019obligation pour les <strong>entreprisses de 11 \u00e0 50 salari\u00e9s<\/strong> ayant r\u00e9alis\u00e9 un <strong>b\u00e9n\u00e9fice net fiscal de 1% pendant 3 ans d\u2019instaurer un dispositif d\u2019\u00e9pargne salarial<\/strong>.<\/p>\n\n\n\n<p>De m\u00eame, les <strong>entreprises de 50 salari\u00e9s et plus <\/strong>devront ouvrir une <strong>n\u00e9gociation<\/strong> sur les modalit\u00e9s de prise en compte dans les <strong>dispositifs de partage de la valeur les r\u00e9sultats exceptionnels r\u00e9alis\u00e9s en France<\/strong>.<\/p>\n\n\n\n<p>Son <strong>entr\u00e9e en vigueur est conditionn\u00e9e \u00e0 son extension et \u00e0 sa transposition<\/strong> l\u00e9gislative et r\u00e9glementaire (<em><u><a href=\"https:\/\/www.afg.asso.fr\/afg-document\/accord-national-interprofessionnel-du-10-fevrier-2023-relatif-au-partage-de-la-valeur-au-sein-de-lentreprise\/\" target=\"_blank\" rel=\"noreferrer noopener\">ANI du 10 f\u00e9vrier 2023 sur le partage de la valeur au sein de l\u2019entreprise<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Epargne salariale<\/h5>\n\n\n\n<p>Un d\u00e9cret pr\u00e9cise la <strong>mise en \u0153uvre de la proc\u00e9dure d\u00e9mat\u00e9rialis\u00e9e<\/strong> de r\u00e9daction d\u2019accords ou d\u00e9cisions d\u2019int\u00e9ressement <strong>permettant de s\u00e9curiser d\u00e8s leur d\u00e9p\u00f4t les exon\u00e9rations sociales et fiscales<\/strong>.<\/p>\n\n\n\n<p>Lorsque l\u2019accord a \u00e9t\u00e9 enti\u00e8rement et exclusivement r\u00e9dig\u00e9 au moyen de la proc\u00e9dure d\u00e9mat\u00e9rialis\u00e9e sur le site de l\u2019URSSAF, il b\u00e9n\u00e9ficie d\u2019un code d\u2019identification au moment de son t\u00e9l\u00e9chargement.<\/p>\n\n\n\n<p>L\u2019accord doit ensuite \u00eatre d\u00e9pos\u00e9 sur le site T\u00e9l\u00e9accords avec le code d\u2019authentification et est r\u00e9put\u00e9 conforme.<\/p>\n\n\n\n<p>Par ailleurs, le d\u00e9cret \u00e9tend la <strong>neutralisation du cong\u00e9 de paternit\u00e9, cong\u00e9s de deuil, ou p\u00e9riodes de mise en quarantaine<\/strong> au <strong>crit\u00e8re<\/strong> de la r\u00e9partition individuelle en fonction du <strong>salaire<\/strong> (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047141018\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02023-98 du 14 f\u00e9vrier 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Paie &#8211; Taxe OFII<\/h5>\n\n\n\n<p>La gestion et le recouvrement de la taxe due par les employeurs de main-d\u2019\u0153uvre \u00e9trang\u00e8re ont \u00e9t\u00e9 transf\u00e9r\u00e9s \u00e0 la DGFIP.<\/p>\n\n\n\n<p>La d\u00e9claration et le paiement de cette taxe \u00e9voluent pour suivre le r\u00e9gime de d\u2019imposition \u00e0 la TVA (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000047213632\" target=\"_blank\" rel=\"noreferrer noopener\">D\u00e9cret n\u00b02023-122 du 21 f\u00e9vrier 2023<\/a><\/u><\/em>).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Actualit\u00e9s jurisprudentielles<\/h2>\n\n\n\n<h5 class=\"wp-block-heading\">Formation du contrat- P\u00e9riode d\u2019essai<\/h5>\n\n\n\n<p>Le <strong>renouvellement<\/strong> de la p\u00e9riode d\u2019essai pr\u00e9vue au sein du contrat de travail est notamment <strong>conditionn\u00e9 \u00e0 l\u2019acceptation du salari\u00e9<\/strong>.<\/p>\n\n\n\n<p>Ce consentement au renouvellement doit \u00eatre claire et <strong>non \u00e9quivoque<\/strong>.<\/p>\n\n\n\n<p>En l\u2019absence de la mention \u00ab&nbsp;bon pour accord&nbsp;\u00bb sur le courrier de renouvellement, il est <strong>possible de s\u2019appuyer sur d\u2019autres \u00e9l\u00e9ments<\/strong>, comme des \u00e9changes de courriel (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000047074118?init=true&amp;page=1&amp;query=21-13-699&amp;searchField=ALL&amp;tab_selection=all\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 25 janvier 2023, n\u00b021-13.699<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Lanceur d\u2019alerte<\/h5>\n\n\n\n<p>Le salari\u00e9 qui <strong>alerte<\/strong> l\u2019Inspection du travail de faits constitutifs d\u2019un <strong>d\u00e9lit ou d\u2019un crime<\/strong> dont il aurait eu connaissance <strong>dans l\u2019exercice de ses fonctions n\u2019a pas l\u2019obligation de respecter la proc\u00e9dure de signalement<\/strong>, <strong>et ne peut pas \u00eatre licenci\u00e9 pour ce motif<\/strong>.<\/p>\n\n\n\n<p>Seule la mauvaise foi caract\u00e9ris\u00e9e du salari\u00e9 ou le caract\u00e8re mensonger des d\u00e9nonciations peuvent \u00eatre r\u00e9pr\u00e9hensibles disciplinairement (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/63ec8bea9dfdee05deff072a\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 15 f\u00e9vrier 2023, n\u00b021-20.342<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Sant\u00e9 et s\u00e9curit\u00e9<\/h5>\n\n\n\n<p>Les salari\u00e9s <strong>expos\u00e9s ill\u00e9galement<\/strong> par leur employeur \u00e0 des <strong>substances ou produits dangereux<\/strong>, comme l\u2019amiante, peuvent obtenir la <strong>r\u00e9paration au titre du manquement \u00e0 l\u2019obligation de loyaut\u00e9<\/strong> de l\u2019employeur, distinct du pr\u00e9judice d\u2019anxi\u00e9t\u00e9 (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/63e34ce3500dc805de37cdb1\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 8 f\u00e9vrier 2023 n\u00b021-14.451<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Arr\u00eat maladie<\/h5>\n\n\n\n<p>L&rsquo;exercice par un salari\u00e9 d&rsquo;une <strong>activit\u00e9 sportive, durant son arr\u00eat maladie<\/strong>, <strong>sans aggravation de son \u00e9tat de sant\u00e9<\/strong>, <strong>ne cause pas \u00e0 son employeur un pr\u00e9judice<\/strong> justifiant sa r\u00e9vocation du fait d&rsquo;un manquement \u00e0 l&rsquo;obligation de loyaut\u00e9, peu important le paiement int\u00e9gral de son salaire (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000047096688?page=1&amp;pageSize=10&amp;query=*badminton&amp;searchField=ALL&amp;searchType=ALL&amp;sortValue=DATE_DESC&amp;tab_selection=juri&amp;typePagination=DEFAULT\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 1 f\u00e9vr. 2023, n\u00b0 21-20.526<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ex\u00e9cution du contrat &#8211; Faute inexcusable<\/h5>\n\n\n\n<p>Les salari\u00e9s victime d\u2019un accident du travail ou d\u2019une maladie professionnelle en raison de la <strong>faute inexcusable<\/strong> de leur employeur peuvent b\u00e9n\u00e9ficier d\u2019une <strong>indemnisation compl\u00e9mentaire pour les souffrances endur\u00e9es apr\u00e8s consolidation<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/63ca685359756f7c906ce1ef\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Civ. 2<sup>\u00e8me<\/sup>, 20 janvier 2023, n\u00b020-23.673 et 21-23.947<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Dur\u00e9e du travail &#8211; Forfait jours<\/h5>\n\n\n\n<p>Le <strong>crit\u00e8re de l\u2019autonomie<\/strong> du salari\u00e9 n\u00e9cessaire pour utiliser le dispositif forfait jours est rempli uniquement s\u2019il dispose d\u2019une <strong>ma\u00eetrise effective et compl\u00e8te de son temps et de son planning de travail<\/strong>.<\/p>\n\n\n\n<p>La taille de l\u2019entreprise ou encore la pr\u00e9sence d\u2019autres salari\u00e9s dans la structure ne sont pas pris en compte (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000047074047?init=true&amp;isAdvancedResult=true&amp;juridictionJudiciaire=Cour+de+cassation&amp;numAffaire=21-16825&amp;origine=juri&amp;page=1&amp;pageSize=10&amp;query=%7B%28%40ALL%5Bt%22*%22%5D%29%7D&amp;sortValue=DATE_DESC&amp;tab_selection=juri&amp;typeRecherche=date\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 25 janvier 2023, n\u00b021-16.825<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Licenciement<\/h5>\n\n\n\n<p><strong>Un salari\u00e9 d\u00e9clar\u00e9 inapte<\/strong> \u00e0 son poste de travail par la M\u00e9decine du travail <strong>ne peut pas \u00eatre licenci\u00e9 pour un autre motif que l\u2019inaptitude et l\u2019impossibilit\u00e9 de reclassement<\/strong>, m\u00eame si l\u2019employeur a engag\u00e9 ant\u00e9rieurement \u00e0 l\u2019avis d\u2019inaptitude une proc\u00e9dure de licenciement disciplinaire (<em><u><a href=\"https:\/\/www.courdecassation.fr\/en\/decision\/63e34cce500dc805de37cd9d\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 8 f\u00e9vrier 2023, n\u00b021-16.258<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Licenciement inaptitude<\/h5>\n\n\n\n<p>La <strong>dispense de recherche de reclassement <\/strong>de l\u2019employeur \u00e0 un salari\u00e9 d\u00e9clar\u00e9 inapte n\u2019est possible <strong>que si l\u2019avis pr\u00e9cise<\/strong> express\u00e9ment <strong>que l\u2019\u00e9tat de sant\u00e9 fait obstacle<\/strong> \u00e0 tout reclassement <strong>dans l&#8217;emploi<\/strong>, et non dans l&rsquo;entreprise (<em><u><a href=\"https:\/\/www.legifrance.gouv.fr\/juri\/id\/JURITEXT000047128350?init=true&amp;page=1&amp;query=21-19.232&amp;searchField=ALL&amp;tab_selection=all\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 8 f\u00e9vrier 2023, n\u00b021-19.232<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Licenciement et garantie d\u2019emploi<\/h5>\n\n\n\n<p>La clause de garantie d\u2019emploi pr\u00e9vue par la Convention collective des Ing\u00e9nieurs et Cadres de la M\u00e9tallurgie n\u2019interdit pas le licenciement d\u2019un salari\u00e9 en arr\u00eat maladie pour d\u2019autres causes que la maladie.<\/p>\n\n\n\n<p>La garantie d&#8217;emploi pour une dur\u00e9e d\u00e9termin\u00e9e n\u2019est pr\u00e9vue que pour le licenciement \u00e0 la suite d&rsquo;une absence pour maladie et n\u00e9cessit\u00e9 de remplacement, et pr\u00e9voient les conditions de l&rsquo;attribution de l&rsquo;indemnit\u00e9 de pr\u00e9avis en l&rsquo;\u00e9tendant pour certains licenciements sp\u00e9cifiques (<em><u><a href=\"https:\/\/www.courdecassation.fr\/en\/decision\/63e34cd4500dc805de37cda3?judilibre_chambre%5B0%5D=soc&amp;previousdecisionpage=0&amp;previousdecisionindex=8&amp;nextdecisionpage=1&amp;nextdecisionindex=0\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 8 f\u00e9vrier 2023, n\u00b021-16.805<\/a><\/u><\/em>).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Rupture du contrat &#8211; Licenciement \u00e9conomique<\/h5>\n\n\n\n<p>L\u2019action du salari\u00e9 li\u00e9e au <strong>non-respect du d\u00e9lai de r\u00e9embauche<\/strong> par l\u2019employeur apr\u00e8s un licenciement pour motif \u00e9conomique <strong>se prescrit<\/strong> \u00e0 compter \u00e0 l\u2019issue d\u2019un <strong>d\u00e9lai de 2 ans \u00e0 compter de l\u2019expiration du d\u00e9lai d\u20191 an suivant la rupture du contrat de travail<\/strong> (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/63da1183b78bc005de6ccd11\" target=\"_blank\" rel=\"noreferrer noopener\">Cass. Soc., 1<sup>er<\/sup> f\u00e9vrier 2023, n\u00b021-12.485<\/a><\/u><\/em>).<\/p>\n\n\n\n<p>Les <strong>difficult\u00e9s \u00e9conomiques<\/strong> peuvent \u00eatre caract\u00e9ris\u00e9es par la seule <strong>d\u00e9gradation de l\u2019exc\u00e9dent brut d\u2019exploitation<\/strong>, si cette d\u00e9gradation est s\u00e9rieuse et durable, et ce malgr\u00e9 une augmentation du CA de l\u2019entreprise (<em><u><a href=\"https:\/\/www.courdecassation.fr\/decision\/63da1187b78bc005de6ccd15\" target=\"_blank\" rel=\"noreferrer noopener\">Cass.
